Be From time to time , the OWNER or ENGINEER will inspect the pollution <br /> control and treatment system and may take effluent samples for analysis by <br /> a testing laboratory selected and paid for by the OWNER . If at any time , the <br /> OWNER or ENGINEER determines that the pollution control and treatment <br /> system is not in compliance with the approved system , the OWNER or <br /> ENGINEER will shut the portion of the project down that is not in compliance , <br /> and it shall remain shut-down until the pollution control and treatment system <br /> is properly constructed or repaired , and complies with the approved pollution <br /> control and treatment system plans and specifications . <br /> C . Schedule construction to minimize erosion and stormwater runoff from the <br /> construction site . Implement erosion control measures on disturbed areas as <br /> soon as practicable in portions of the site where construction activities have <br /> temporarily or permanently ceased , but in no case more than 7 days after the <br /> construction activity in that portion of the site has temporarily or permanently <br /> ceased . <br /> D . Inspect each pollution control system at least once per day . Clean and <br /> maintain each pollution control system as required by its manufacturer or the <br /> OWNER , until the system is no longer needed . If a water quality violation <br /> occurs , immediately cease all work contributing to the water quality violation <br /> and correct the problem . <br /> E . Discharge shall not violate State or local water quality standards in the <br /> receiving waters , nor cause injury to the public health or to public or private <br /> property , nor to the Work completed or in progress . The receiving point for <br /> water from construction operations shall be approved by the applicable <br /> regulatory agency and the ENGINEER . <br /> F . Promptly repair all damage at no cost to the OWNER . <br /> 1 . 4 SUBMITTALS <br /> A . Shop Drawings : Submit shop drawings of the proposed pollution control and <br /> treatment systems in accordance with Article 6 . 17 of the General Conditions . <br /> 1 . 5 STATE CERTIFIED EROSION CONTROL SPECIALTY SUBCONTRACTOR IS <br /> REQUIRED FOR DESIGN , INSTALLATION , AND MAINTENANCE <br /> A. Site-specific design of the erosion and stormwater pollution control system , <br /> and installation and maintenance of all erosion and stormwater pollution <br /> control devices , shall be by a State certified erosion control specialty <br /> subcontractor who specializes in the design , installation , and maintenance of <br /> such devices . After installation , this subcontractor shall maintain the erosion <br /> and stormwater pollution control devices until the devices are no longer <br /> necessary . ( Note : The CONTRACTOR may install and maintain the erosion <br /> and stormwater pollution control system under the direction of the State <br /> certified erosion control specialty subcontractor . ) Before beginning <br /> construction , submit to the ENGINEER for review , a Stormwater Pollution <br /> F :\Engineering\Special Projects\Eagle Trace Phase Montract Documents\Eagle Trace Subdivision Phase II\9611A & 0001 - Technical <br /> Provisions.doc - 4 - <br />
