11 .2 DEVELOPER agrees to implement the project(s) and comply with the Scope of Services <br /> set forth in Appendix A and Timetable set forth in Appendix N. <br /> ARTICLE XII — OTHER PROVISIONS <br /> 12 . 1 Equal Employment Opportunity <br /> The following provisions "a" and "b" are applicable to all contracts and subcontracts ; <br /> provisions "c" through "g" are applicable to all non-exempt construction contracts and <br /> subcontracts which exceed $ 10,000 ; <br /> During the performance of this contract, DEVELOPER agrees as follows : <br /> a. DEVELOPER shall not discriminate against any applicant for purchase of <br /> housing units or applicant for employment because of race, color, creed, religion, <br /> sex, age, handicap, disability, ancestry, national origin, marital status, familial <br /> status, or any other basis prohibited by applicable law. DEVELOPER shall take <br /> affirmative action to ensure that applicants who are employed are treated during <br /> employment without regard to their race, color, creed, religion, sex, age, <br /> handicap, disability, ancestry, or national origin. Such action shall include, but <br /> not be limited to the following : employment, upgrading, demotion or transfer, <br /> recruitment or recruitment advertising, layoff or termination, rates of pay or other <br /> forms of compensation, and selection for training, including apprenticeship . <br /> DEVELOPER agrees to post in conspicuous places, available to employees and <br /> applicants for employment, notices to be provided setting forth the provisions of <br /> his nondiscrimination clause. <br /> b. DEVELOPER will, in all solicitations or advertisement for applicants to qualify <br /> for purchase of housing units, or employees placed by or on behalf of <br /> DEVELOPER, state that all qualified applicants will receive consideration for <br /> qualification or employment without regard to race, color, creed, religion, sex, <br /> age, handicap, disability, ancestry, national origin, marital status, or any other <br /> basis prohibited by applicable law. <br /> c . DEVELOPER will send to each labor union or representative or workers with <br /> which it has a collective bargaining agreement or other contract or understanding, <br /> a notice to be provided advising the said labor union or workers representatives of <br /> DEVELOPER commitments under this section, and shall post copies of the notice <br /> in conspicuous places available to employees and applicants for employment. <br /> d . DEVELOPER will comply with all provisions of Executive Order 11246, Equal <br /> Employment Opportunity, of September 24, 1965 , as amended by Executive <br /> Orders 11375 and 12086 , copies of which are on file and available at COUNTY, <br /> and of the rules, regulations, and relevant orders of the Secretary of Labor. <br /> e. DEVELOPER will furnish all information and reports required by Executive <br /> Order 11246 of September 24, 1965 , as amended, and by rules, regulations, and <br /> orders of the Secretary of Labor, or pursuant thereto, and will permit access to its <br /> books, records, and accounts by DEPARTMENT, HUD and the Secretary of <br /> 14 <br />
