C) If <br /> rl <br /> AGREEMENT TO PURCHASE AND SELL REAL ESTATE AND CONVEY <br /> DRAINAGE EASEMENT <br /> BETWEEN <br /> AND INDIAN RIVER COUNTY AND VISTA PROPERTIES OF VERO <br /> BEACH , INC . <br /> THIS AGREEMENT TO PURCHASE AND SELL REAL ESTATE ( "Agreement " ) is <br /> made and entered into as of the 17th day of March , 20097 by and between Indian <br /> River County , a political subdivision of the State of Florida ( "the County" ) , and Vista <br /> Properties of Vero Beach , Inc . , a Florida Corporation , ( " Seller" ) , who agree as follows : <br /> WHEREAS , Vista Properties of Vero Beach , Inc . owns a 75 . 75 ± acre parcel of <br /> property located at 6600 20th Avenue ( State Road 60 ) Vero Beach , FL . The eastern edge <br /> of the property abuts 66th Avenue . A sketch and legal description of the property is <br /> attached to this agreement as Exhibit "A " and incorporated by reference herein ; and <br /> WHEREAS , the County , is scheduled to expand 66th Avenue in the near future and <br /> the road expansion will impact and affect the Seller' s property ; and <br /> WHEREAS , in order for the County to proceed with its road expansion plans , the <br /> County needs to purchase property to be used as right- of-way from landowners adjacent to <br /> 66th Avenue ; and <br /> WHEREAS , in order for the County to proceed with its road expansion plans , the <br /> County needs to acquire an interest in property to be used as a stormwater retention pond <br /> from landowners adjacent to 66th Avenue ; and <br /> WHEREAS , in order for the County to construct the expanded roadway and install <br /> the necessary drainage pipes and equipment , the County needs to acquire an interest in <br /> property to be used as a temporary construction easement from landowners adjacent to <br /> 66th Avenue ; and <br /> WHEREAS , the County has contacted Seller and has offered to purchase a 2 , 995 <br /> square foot ( 0 . 069 acre ) parcel of property from Seller to be used as right- of-way as <br /> depicted on Exhibit "A" (the Right- of-Way Property) ; and <br /> WHEREAS , the County has also offered to purchase an easement from Seller that <br /> would permit the County to drain stormwater runoff from the expanded 66th Avenue into the <br /> lakes system owned by Seller as depicted on Exhibit " B " (the Drainage Easement) ; and <br /> WHEREAS , the County has also offered to purchase an easement from Seller that <br /> would permit the County to construct and install the necessary drainage pipes and <br /> equipment on Seller' s property as depicted on Exhibit " C " (the Temporary Construction <br /> Easement) .
