L <br />areas is restricted during the sea turtle nesting season from March 1 through <br />October 31. As may be necessary the OWNER may suspend WORK in the area <br />seaward of the coastal primary dune line during this period as may be required by <br />the Florida department of environmental Protection (FDEP) permit. Suspension of <br />work described above shall not form a basis for claims by the CONTRACTOR for <br />time extensions or incurred costs. <br />B. Permits and Licenses: Indian River County will obtain the necessary FDEP permit. <br />Any other permits and licenses required for the work shall be secured and paid for <br />by the CONTRACTOR. Copies of all certifications, licenses, and permits obtained <br />by the CONTRACTOR shall be provided to the OWNER prior to commencement of <br />the WORK. <br />The CONTRACTOR will be provided a copy of the FDEP permit. By submission of <br />his bid, the CONTRACTOR warrants that he shall comply with the permit conditions <br />as they apply to the CONTRACTOR'S WORK specified herein. Any questions <br />regarding permit conditions will be addressed at the Pre -construction meeting. <br />The CONTRACTOR shall abide by all notes and conditions on the plans and <br />specifications and all applicable permits; specifically those involving beach tilling, <br />prohibition of discharge of oil and debris, placement of non -suitable beach fill, etc. <br />and as may be specified elsewhere herein. If the CONTRACTOR violates any <br />condition of the permit resulting in the stopping of WORK by the State of Florida or <br />other public entity, then any additional costs incurred by the CONTRACTOR shall be <br />paid by the CONTRACTOR and not charged to the OWNER. <br />The CONTRACTOR shall post copies of all permits at the job sites in a manner <br />clearly visible. <br />C. Turtle Nesting Season: As specified above this Project must be constructed outside <br />of sea turtle nesting season except as otherwise provided for in the FDEP permit <br />authorizing the work. The CONTRACTOR shall comply with all State and Federal <br />permit restrictions regarding construction activity within the project boundaries. All <br />equipment shall be removed from the project site on or before the date specified by the <br />OWNER at the Pre -Construction Meeting to allow for turtle nesting. The CONTRACTOR <br />should plan to cease work at the start of the turtle nesting season unless otherwise <br />specifically authorized in writing by the OWNER and FDEP to continue construction. In <br />the event WORK is allowed to proceed into the early part of sea turtle nesting season <br />(March 1 to March 31) CONTRACTOR will be required to wait for clearance from sea <br />turtle nesting surveyors before starting work each morning and will be required to <br />avoid any marked sea turtle nests. <br />+ + END OF SECTION + + <br />Last Revised 1/2008 01009-3 Wabasso Beach Pk.
