RESOLUTION NO. 67- 37 i <br />WHE .LEAS, by the provisions of Chapter 61-2272, Laws of <br />Florid, Acts of 1961, the Board of County Commissioners of Indian River <br />County, Florida, is authorized and empowered to adopt rules and regulations <br />limiting, restricting or prohibiting the operation of motor vehicles upon any <br />and all or any part of the public beaches located in Indian River County, <br />Florida; and, <br />WHEREAS, pursuant to said authority, this Board adopts the` rules <br />and regulations hereinafter set forth, after having given due consideration to <br />the -necessity for such rules and regulations and after having found and deters <br />mined that the health, welfare and safety of the people of Indian River County, <br />Florida, require that such rules and regulations be adopted; Now, therefore, <br />BE IT RESOLVED by the Board of County Commissioners of <br />Indian River County, Florida: <br />Section 1. For the purpose of this Resolution, certain terms <br />and words are defined as follows: <br />MOTOR VEHICLE. Every device which is self :propelled <br />and in, upon or by which person, persons or property is, <br />are or may be transported. <br />PUBLIC BEACHES. That part of the shore of the Atlantic <br />Ocean in Indian River County, Florida, extending from the <br />ordinary high water mark to the waters of the Atlantic Ocean <br />and extending from an eastward projection of Wabasso Beach <br />Road northward a distance of 1,000 feet and southward a <br />distance of 600 feet. <br />Section 2. No person shall operate a motor vehicle on the public <br />beaches of Indian River County, Florida, at a rate of speed in -excess of 15 <br />miles per hour. <br />Section 3. No person shall operate a motor vehicle upon the <br />public beaches of Indian River County, Florida, . between the hours of 6:00 A.
