PETITION TO VACATE EASEMENT Comes now AMERICAN MUTUAL CORPORATION, a Florida corporation by and through the undersigned attorney, and respectfully. Petitions the Board of County Commissioners Indian River County, Florida, as folloWs: A. That STANDARD OIL COMPANY (incorporated in Kentucky) is in the process of purchasing part of the following described property located in Indian River County, Florida, from your Petitioner, to -it: Lots 1, 2, 11, 12 and 13, Block D in the Plat of VERO LAKE ESTATES SIM - DIVISION, UNIT H-4, filed in the office.of.the Clerk of the Circuit Court of Indian. River County, Florida 'in Plat Book 6, page 31. 2. That the plat of said lands duly recorded in the public records of Indian River County, Florida, in Plat Book 6, page 31 shows the dedication of "a 10 foot public utilities and drainage easement on the rear lot line of Lots.1, 2, 11, 12 and 13. . . 3. It is necessary that the aforesaid easement be vacated insofar as it affects the above described property in order that a filling station may be con- structed on the property over and across the said easements. 4. That the vacation of the said easement will not adversely affect the surrounding lands or will not affect the ownership of persons owning other parts of said subdivision. 5. That all state and county taxes on the said land have been fully paid as shown in Abstract #30308, prepared by Title Security Company through the year 1967.' WHEREFORE, Petitioner respectfully petitions the Board of County Commissioners :of Indian River County, Florida to vacate and abandon and relinquish and disclaim all the rights of the public acquired by the dedication of the aforesaid easements. • CAN MUTUAL CORPORATION H.
