EXHIBIT 1 <br /> Indian River County Sector 3 Phase 2 - Construction Phase Services <br /> Scope of Work <br /> WORK ORDER 11 <br /> Sector 3 Beach and Dune Restoration Project <br /> Phase 2 - Construction Phase Services <br /> Overview : This Scope of Work is intended to provide services in support of construction and monitoring <br /> prior to, during, and after construction of Phase 2 of the Sector 3 Beach and Dune Restoration Project. <br /> Phase 2 construction is expected to : <br /> • employ the same upland sand sources and Contractor as employed in Phase 1 construction , and <br /> ■ occur between December 1 , 2010 and April 30, 2011 . <br /> Note that the monitoring under this Scope of Work provides for immediate post-construction monitoring <br /> of the Phase 2 fill area and the "year l " annual monitoring for the previously completed Phase I fill area — <br /> subject to approval of FDEP . <br /> In general , the work will support the efforts of COUNTY staff, be performed by COASTAL TECH, and <br /> supported (via sub-contracts) by Ecological Associates, Inc . ( EAI ), CSA International , Inc . (CSA ), Aerial <br /> Cartographics of America (ACA), Morgan & Eklund , Inc . (M &E), and Inwater Research Group (IRG) as <br /> described below . The following describes the work under this Scope of Work: <br /> Part 1 — Pre- Construction Services <br /> Specific Condition 33 of the FDEP permit and Special Condition 5 of the USAGE permit require <br /> obtainment of a Notice to Proceed for Phase 2 construction in accordance with the "Nesting Test <br /> Plan" . The work under Part I entails a Notice-to-Proceed and pre-construction meeting - as required <br /> for Phase 2 construction . <br /> Task la — FDEP Notice to Proceed : The COUNTY will submit the Nesting Test Plan results to the <br /> ACNWR, IRC Marine Turtle Research , USF&WS and FFWCC by October 30, 2010 as expected to <br /> obtain - within 15 days - a favorable review and response from these agencies . COASTAL TECH will <br /> participate in up to two telephone conference calls with these agencies . If required, the COUNTY and <br /> COASTAL TECH will also schedule a meeting with ACNWR, IRC Marine Turtle Research, <br /> USF&WS and FFWCC to discuss the reproductive success data compiled under the agency approved <br /> Nesting Test Plan . COASTAL TECH will assist the COUNTY with obtainment of written <br /> confirmation from all agencies that the conditions of the Nesting Test Plan have been met for the <br /> COUNTY to proceed with Phase 2 construction utilizing the upland sand sources . The COUNTY <br /> will obtain a Special Use Permit from Archie Carr National Wildlife Refuge to place fill in the refuge . <br /> Upon favorable results as described above, COASTAL TECH will compile and submit the following <br /> information to FDEP to obtain the required Notice to Proceed utilizing an upland sand source : <br /> (a) USFWS and FFWCC written confirmation that the conditions of the "Upland Sand Source <br /> Sea Turtle Nesting Test Plan " have been met, <br /> ( b) the Special Use Permit from Archie Carr National Wildlife Refuge, <br /> (c) a revised project description to include restoration of the Phase I construction template and <br /> R20 to R33 (Phase 2 fill area) <br /> (d ) signed/sealed construction drawings , <br /> (e) Technical Specifications, <br /> ( f) Resumes of consultants proposed to conduct shorebird , turtle, and biological monitoring <br /> services, <br /> Page I of 8 <br /> October 4 , 2010 <br />
