Contractor' s failure to provide notice upon discovery of the differing site condition shall waive any entitlement to such an adjustment in the Contract Price or Contract Time . Based on Archaeologist' s determination , Contractor shall then submit a Change Order in order to avoid resources or mitigate as required to proceed with project . ARTICLE 5 - BONDS AND INSURANCE SC 5 . 01A Replace the words " performance and payment bonds " with the words " Public Construction Bond . " ; then add the following sentence immediately after the existing text in paragraph 5 . 01A of the General Conditions : Pursuant to Florida Statutes section 255 . 05 ( 1 ) ( a ) ( 2007 ) , any claimant ( as such term is defined in Florida Statutes section 713 . 01 ) may apply to Indian River County as Owner for copies of the Agreement and the recorded payment and performance bonds and shall thereupon be furnished with certified copies of such documents .
