The 2011 Amendments to the <br /> Shelter Plus Care Codified Regulation <br /> Billing Code 4210-67 <br /> PART 582- SHELTER PLUS CARE <br /> PROGRAM ( 2 ) An individual from birth to age 9, inclusive, <br /> who has a substantial developmental delay or <br /> specific congenital or acquired condition, may <br /> be considered to have a developmental <br /> 3 . The authority citation for 24 CFR part disability without meeting three or more of the <br /> 582 continues to read as follows : criteria described in paragraphs ( 1 )( i) through <br /> Authority: 42 U . S . C. 3535 ( d ), and (v) of the definition of "developmental disability " <br /> 11403- 1140713 . in this section if the individual, without services <br /> and supports, has a high probability of meeting <br /> those criteria later in life. <br /> 4. In § 582 . 5 , the definition of Homeless or <br /> homeless individual " is removed , the definitions <br /> of " Developmental disability" and " Homeless" <br /> are added , and the definition of " Person with <br /> disabilities" is revised to read as follows : Homeless means : <br /> ( 1 ) An individual or family who lacks a fixed, <br /> regular, and adequate nighttime residence, <br /> 4582 . 5 Definitions. meaning . <br /> ( i ) An individual or family with a primary <br /> * * * * nighttime residence that is a public or private <br /> Developmental disability means, as defined place not designed for or ordinarily used as a <br /> in section 102 of the Developmental Disabilities regular sleeping accommodation for human <br /> Assistance and Bill of Rights Act of 2000 (42 beings, including a car, park, abandoned <br /> U . S . C. 15002 ) : building, bus or train station , airport, or <br /> ( 1 ) A severe, chronic disability of an individual camping ground ; <br /> that- ( ii ) An individual or family living in a <br /> ( i ) Is attributable to a mental or physical supervised publicly or privately operated shelter <br /> impairment or combination of mental and designated to provide temporary living <br /> physical impairments; arrangements ( including congregate shelters, <br /> Is manifested before the individual transitional housing, and hotels and motels paid <br /> ( ii ) for by charitable organizations or by federal , <br /> attains age 22 ; state, or local government programs for <br /> ( iii ) Is likely to continue indefinitely; low- income individuals) ; or <br /> ( iv) Results in substantial functional ( iii ) An individual who is exiting an institution <br /> limitations in three or more of the following where he or she resided for 90 days or less and <br /> areas of major life activity : who resided in an emergency shelter or place <br /> (A) Self-care; not meant for human habitation immediately <br /> ( B) Receptive and expressive language ; before <br /> ( C) Learning ; entering that institution ; <br /> ( D) Mobility; ( 2 ) An individual or family who will imminently <br /> ( E) Self-direction ; lose their primary nighttime residence, provided <br /> ( F) Capacity for independent living ; that : <br /> ( G) Economic self-sufficiency ; and ( i ) The primary nighttime residence will be <br /> (v) Reflects the individual's need for a lost within 14 days of the date of application for <br /> combination and sequence of special, homeless assistance; <br /> interdisciplinary, or generic services, ( ii ) No subsequent residence has been <br /> individualized supports, or other forms of identified; and <br /> assistance that are of lifelong or extended ( iii ) The individual or family lacks the <br /> duration and are individually planned and resources or support networks, e. g . , family, <br /> coordinated . friends, faith- based or other social networks, <br /> needed to obtain other permanent housing ; <br /> www. hud. gov cspanol. hud. gov Page 19 <br />
