I . Storm Debris . The District shall have the exclusive right to determine <br /> how the District will dispose of Acceptable Waste generated by a hurricane , natural <br /> disaster, or other event that produces unusually large quantities of Acceptable Waste <br /> (collectively, " Storm Debris ") . The District shall designate the Facility Site as one of the <br /> locations in the County that are deemed suitable for the management and disposal of <br /> Storm Debris and, thereafter, the District shall notify the Florida Department of <br /> Environmental Protection of this designation . The District shall make a good faith effort <br /> to direct as much Storm Debris to the Company as possible ; however, the District shall <br /> not be obligated to provide Storm Debris to the Company, and the District shall have no <br /> liability to the Company if the District in its sole discretion determines that it is not <br /> appropriate or otherwise in the District ' s best interests to provide Storm Debris to the <br /> Company . <br /> J . Limitations on Waste Disposal in Landfill . The District reserves its <br /> exclusive right to determine whether, and the extent to which , any type or quantity of <br /> solid waste may be disposed of in the Landfill . Notwithstanding anything else contained <br /> herein , the District shall have the right to prohibit the disposal of any material in the <br /> Landfill if the District, in its sole discretion, determines that the disposal of such material <br /> is not appropriate or otherwise in the District ' s best interests . The District also reserves <br /> the exclusive authority to establish restrictions concerning the use of the Landfill , <br /> including but not limited to restrictions concerning the times , conditions , and manner in <br /> which waste materials may be disposed of in the Landfill . However, any restrictions or <br /> limitations shall apply equally to all Persons . <br /> Section 3 .2 Company Responsibilities and Obligations . <br /> A. Accept and Process Acceptable Waste The Company agrees to accept <br /> and Process all of the Acceptable Waste delivered to the Facility Site by the District, <br /> Contractors , Franchisees , and Residents . <br /> B . Feedstock Delivery Plan . The Company shall prepare a Feedstock <br /> Delivery Plan , which shall describe the specific procedures that will be used by the <br /> Company to manage the ingress , unloading, and egress of the vehicles delivering solid <br /> waste to the Facility Site . The Company ' s procedures shall be designed to ensure that all <br /> vehicles delivering Acceptable Waste to the Facility Site will be able to enter, unload, <br /> and leave the Facility Site as expeditiously as possible . The Feedstock Delivery Plan also <br /> shall describe the procedures that shall be used by the Company when handling, testing, <br /> disposing, or otherwise managing any Unacceptable Waste or Hazardous Waste that is <br /> delivered to the Facility Site . The Feedstock Delivery Plan shall be provided to the <br /> District at least fourteen ( 14) days before the Company begins receiving deliveries of <br /> Acceptable Waste from the District, Contractors , Franchisees or Residents . <br /> 16 <br />
