C . Weighing, Inspection and Record Keeping . <br /> 1 . The Company shall install scales on the Facility Site which shall <br /> be used to weigh each vehicle delivering materials to the Facility . The Company shall <br /> calibrate the scales before the Commencement Date and regularly thereafter throughout <br /> the term of this Agreement . The Company shall calibrate the scales at the Facility Site at <br /> least as frequently as the District calibrates its scales at the Landfill . The District shall <br /> have the right to observe the operations in Company ' s scale house during any time when <br /> vehicles are being received at the Facility Site for the delivery of waste . District may <br /> inspect and calibrate the scales at any reasonable time , not to exceed once per month, at <br /> the District ' s expense . <br /> 2 . Each vehicle shall be weighed on the scales operated by Company <br /> at the time of each delivery to the Facility Site . At the time of its first delivery and <br /> periodically thereafter, each vehicle shall be weighed empty to confirm the correct tare <br /> weights . <br /> 3 . District, Contractor and Franchisee vehicles will bear markings or <br /> decals reasonably satisfactory to Company to allow for proper and expeditious weighing <br /> and billing . Company, in its sole discretion , shall have the right to inspect the contents of <br /> any vehicle delivering material on behalf of the District to determine whether the <br /> delivered material complies with the requirements of this Agreement . <br /> 4 . Company shall keep adequate records concerning all deliveries . At . <br /> a minimum, the Company ' s records shall provide the following information for each <br /> delivery : the date ; time ; vehicle number; weight of delivered material ; and whether the <br /> material delivered was Acceptable Waste , Unacceptable Waste, or was Refused . The <br /> Company also shall determine and report whether the Person delivering waste was a <br /> Resident . <br /> D . Rejection of Deliveries . The obligations of Company with regard to the <br /> discovery of Hazardous Waste delivered by or on behalf of the District are as follows : (i) <br /> notify the District; (ii) take such action as the Company deems appropriate , consistent <br /> with the permits governing the Facility Site , directives of any regulatory agency or <br /> authority having jurisdiction and applicable law; (iii) remove such waste to a safe <br /> location , if necessary and practicable, within the Facility Site or, if necessary, from the <br /> Facility Site, all at the District's expense ; (iv) cooperate and assist the District with regard <br /> to the District' s obligation to promptly remove such waste from the Facility Site ; and (v) <br /> use due care with regard to such waste . The District shall reimburse Company, on <br /> demand, for reasonable out-of-pocket costs and expenses paid to third parties arising out <br /> of the delivery by the District to the Facility Site of Hazardous Waste . <br /> 17 <br />
