Payments shall be made by the District for all of <br /> the Acceptable Waste that is Processed by the Company, even if such waste is Processed <br /> before the Commencement Date . Payments shall be made by the Company for all of the <br /> Landfill Gas that is used by the Company, even if such use occurs before the LFG <br /> Commencement Date . Beginning on October 1 , 2014 , all of these fees shall be adjusted <br /> annually in compliance with the procedures and restrictions set forth herein . <br /> 2 . The District shall pay the Processing Fee for each Ton of Acceptable <br /> Waste that is delivered to the Facility by the District, its Contractor, Franchisees , and <br /> Residents . The District also shall pay a Supplemental Processing Fee to the Company for <br /> each Ton of Acceptable Waste delivered on behalf of the District that is not Processed <br /> into Mulch and returned to the District . The District shall not pay the Supplemental <br /> Processing Fee for the Mulch (up to 25 , 000 Tons per Contract Year, as provided in <br /> Section 3 . 1 . A . 2 , above) that the District receives from the Company . <br /> 3 . Company shall be solely responsible for billing and collecting all <br /> of the Processing Fees and Tipping Fees for the use of its Facility.. <br /> 4 . If Acceptable Waste is delivered to the Facility by a Resident, the <br /> Company will collect Processing Fees and any applicable Supplemental Processing Fees <br /> from the District in lieu of collecting a fee from the Resident . However, Company shall <br /> be responsible for verifying the identification of each Resident that uses the Facility and <br /> maintaining appropriate records concerning the method of verification . <br /> 5 . The Tipping Fee (currently $ 22 . 00 per Ton) for receiving Land <br /> Clearing Debris shall be collected by the Company and paid to the District, after the <br /> Company deducts the Processing Fee and any applicable Supplemental Processing Fee <br /> for such material . Similarly, the Tipping Fee (currently $ 18 . 00) for receiving Mulch shall <br /> be collected by the Company and paid to the District, after the Company deducts any <br /> applicable Supplemental Processing Fee for such material . <br /> 6 . As shown in Exhibit 1 -B , the Company shall pay a disposal fee <br /> (currently $ 18 . 46 per Ton) to the District for the disposal of Unacceptable Waste and <br /> " other materials not suitable for Company operations . " This disposal fee shall only apply <br /> to the first ten thousand ( 10 , 000) Tons of such waste that are delivered to the Landfill by <br /> the Company during a Contract Year. If the Company delivers more than ten thousand <br /> ( 10, 000 ) Tons of such waste to the Landfill in any Contract Year, the District shall be <br /> paid the District ' s standard "gate rates " for all of the waste that exceeds ten thousand <br /> ( 10 , 000) Tons . The gate rates are established by the County each year and adopted by <br /> County resolution . The gate rates are based on the type of material (e . g. , waste tires ; <br /> garbage ; C & D Waste) that is delivered to the Landfill for disposal . <br /> 22 <br />
