J <br /> (2 ) In compliance with Florida Statute ( Section 287 . 087 ) attached form " Drug - Free <br /> Workplace Certification " should be fully executed and submitted with bid response . <br /> (3 ) The Uniform Commercial Code ( Florida Statutes , Chapter 672 ) shall prevail as the <br /> basis for contractual obligations between the awarded contractor/vendor and the County <br /> for any terms and conditions not specifically stated in the Invitation for Bid . <br /> (4 ) The obligations of the County under this award are subject to the availability of funds <br /> lawfully appropriated for its purpose . <br /> ( 5 ) This Invitation for Bid shall be included and incorporated in the final award . The <br /> order of contractual precedence will be the purchase order or price agreement release , <br /> bid document (original Terms and Conditions ) , and response . Any and all legal action <br /> necessary to enforce the award will be held in the County and the contractual obligations <br /> will be interpreted according to the laws of Florida . <br /> 6 . CERTIFICATION , LICENSES AND PERMITS <br /> Vendor must include with his bid a copy of all applicable Certificates of Competency issued by <br /> the State of Florida or the Indian River County Building Division and a current Occupational Tax <br /> Certificate for Indian River County in the name of the vendor shown on the bid proposal page . If <br /> awarded contract, vendor will be required to obtain an Occupational Tax Certificate for the <br /> County . It shall also be the responsibility of the vendor to submit , prior to commencement of <br /> work , any and all permits required to complete this contractual service at no additional cost to <br /> the County . <br /> 7 . SUBCONTRACTING <br /> If a vendor subcontracts any portion of a contract for any reason , he must include , in writing , the <br /> name and address of all Minority and Non - Minority subcontractors , their telephone numbers and <br /> extent of work to be performed . This information shall be submitted with bid proposal on the <br /> Schedule of Subcontractors . All Small Business Enterprise subcontractors must be listed on the <br /> Statement of Small Business Subcontractor Participation and this information submitted with bid <br /> 53 <br /> 12/29/2009 2:23:44 PM <br />
