6 . CIVIL RIGHTS
<br /> The following requirements will apply to the awarded contract and any sub-contracts :
<br /> ( 1 ) Age . In accordance with section 4 of the Age Discrimination in Employment Act of 1967 ,
<br /> as amended , 29 U . S . C . §623 , the Contractor agrees to refrain from discrimination
<br /> against present and prospective employees for reason of age . In addition , the
<br /> Contractor agrees to comply with any implementing requirements FHWA may issue .
<br /> (2 ) Disabilities . In accordance with section 102 of the Americans with Disabilities Act, as
<br /> amended , 42 U . S . C . § 12112 , the Contractor agrees that it will comply with the
<br /> requirements of U . S . Equal Employment Opportunity Commission , " Regulations to
<br /> Implement the Equal Employment Provisions of the Americans with Disabilities Act, " 29
<br /> C . F . R . Part 1630 , pertaining to employment of persons with disabilities . In addition , the
<br /> Contractor agrees to comply with any implementing requirements FTA may issue .
<br /> ( 3) The Contractor also agrees to include these requirements in each subcontract financed
<br /> in whole or in part with Federal assistance .
<br /> 7 . NONSEGREGATED FACILITIES
<br /> (Applicable to all Federal-aid construction contracts and to all related subcontracts of $ 10 , 000 or
<br /> more . )
<br /> a . By submission of this bid , the execution of the contract or subcontract, or the
<br /> consummation of this material supply agreement or purchase order, as appropriate , the
<br /> bidder, Federal -aid construction contractor, subcontractor, material supplier, or vendor,
<br /> as appropriate , certifies that the firm does not maintain or provide for its employees any
<br /> segregated facilities at any of its establishments , and that the firm does not permit its
<br /> employees to perform their services at any location , under its control , where segregated
<br /> facilities are maintained . The firm agrees that a breach of this certification is a violation of
<br /> the EEO provisions of this contract. The firm further certifies that no employee will be
<br /> denied access to adequate facilities on the basis of sex or disability .
<br /> b . As used in this certification , the term "segregated facilities" means any waiting rooms ,
<br /> work areas , restrooms and washrooms , restaurants and other eating areas , timeclocks ,
<br /> locker rooms , and other storage or dressing areas , parking lots , drinking fountains ,
<br /> recreation or entertainment areas , transportation , and housing facilities provided for
<br /> employees which are segregated by explicit directive , or are , in fact, segregated on the
<br /> basis of race , color, religion , national origin , age or disability , because of habit , local
<br /> custom , or otherwise . The only exception will be for the disabled when the demands for
<br /> accessibility override ( e . g . disabled parking ) .
<br /> C . The contractor agrees that it has obtained or will obtain identical certification from
<br /> proposed subcontractors or material suppliers prior to award of subcontracts or
<br /> consummation of material supply agreements of $ 10 , 000 or more and that it will retain
<br /> such certifications in its files .
<br /> 8 . PAYMENT OF PREDETERMINED MINIMUM WAGE
<br /> (Applicable to all Federal-aid construction contracts exceeding $2 , 000 and to all related
<br /> subcontracts , except for projects located on roadways classified as local roads or rural minor
<br /> collectors , which are exempt. )
