to the construction site , all materials , plant and equipment required for the performance of the Contract. <br /> Material and equipment subject to degradation by outside exposure shall be stored in a weather-tight <br /> enclosure provided by Contractor at its expense . <br /> GC 23 FIRE PROTECTION <br /> All necessary precautions to avoid and eliminate fire hazards shall be the responsibility of the <br /> Contractor. Contractor shall provide portable fire extinguishers , properly labeled , located and compatible <br /> with the hazard of each work area and shall instruct personnel in their use . <br /> GC 24 ILLUMINATION <br /> When any work is performed when daylight is obscured or at night , Contractor shall , at its <br /> expense , provide artificial light sufficient to permit work to be carried on satisfactorily and safely . <br /> GC 25 DUST CONTROL <br /> For the duration of the contract, the Contractor shall , at its expense , maintain all excavations , <br /> roads , plant . sites , borrow areas and all other work areas free from dust. Code-required or industry- <br /> accepted methods of dust control suitable for the area involved and approved by Owner will be permitted . <br /> GC 26 POLLUTION CONTROL <br /> Contractor shall , at its expense , perform its work so as not to discharge into the atmosphere , any <br /> body of water, the ground or groundwater, from any source , smoke , dust or other contaminants in <br /> violation of the laws , rules and regulations of all federal , state and local air and water <br /> pollution <br /> requirements . Contractor shall , at its expense , provide suitable facilities to prevent any such discharges . <br /> Contractor shall immediately report to Owner and appropriate authorities any spill of contaminant . <br /> GC27 DEBRIS DISPOSAL <br /> All debris shall be legally disposed of at licensed disposal site( s) . <br /> GC 27 EXPLOSIVES AND HAZARDOUS MATERIALS <br /> Contractor shall obtain all required federal , state and local permits and licenses and shall be <br /> responsible for the safe and proper handling , transportation , storage and use of any explosive <br /> or <br /> hazardous material brought onto or encountered with in the site . The Contractor will notify the Owner <br /> immediately if explosive or hazardous materials are encountered on the site . Contractor shall maintain <br /> and post as necessary , Material hazard Data Sheets for all applicable hazardous materials used in the <br /> course of the work . In the event that hazardous material is improperly handled or stored <br /> by the <br /> Contractor or its sub-contractors , which results in contamination of the site , Contractor shall immediately <br /> notify the Owner and the appropriate governmental authority and shall take whatever action is necessary <br /> or desirable to remediate the contamination at the Contractor' s sole cost and expense . Contractor shall <br /> indemnify and hold harmless the Owner from any expense , action or liability resulting from <br /> such <br /> contamination and remedial actions . <br /> GC 28 LABOR <br /> Contractor shall employ only competent and skilled personnel to perform the work . Contractor <br /> shall , if requested by Owner, remove from the jobsite any personnel of Contractor who is determined by <br /> Owner to be unfit or working in violation of any provision of the Contract. Contractor and all <br /> subcontractors shall be bound by and comply with all applicable Federal , State and local laws regarding <br /> labor. All work performed after regular working hours , on Sundays or legal holidays , shall be performed <br /> without additional expense to the Owner. <br /> GC 29 SAFETY <br /> The Contractor shall be responsible for initiating , maintaining and supervising all safety <br /> precautions and programs in connection with the work. Contractor will provide to each worker on the job <br /> site the proper safety equipment for the duties being performed by the worker and will not permit any <br /> worker on the job site who fails or refuses to use the safety equipment. The Contractor shall provide and <br /> maintain all necessary watchmen , barricades , warning lights , and signs and take all necessary <br /> precautions for the protection of all persons involved in the work , the public , and all employees <br /> or <br /> 37 <br /> 12/1!2009 3:45:46 PM <br />
