representatives of Owner. All work and all equipment, machinery , materials and tools shall be in <br /> compliance with and conform to all applicable laws , ordinance , rules and regulations . <br /> GC 30 PROGRESS <br /> During construction , Contractor shall keep a marked - up and up -to-date set of drawings showing <br /> as - built conditions on that site as an accurate record of all deviations between work as shown and work <br /> as installed . These drawings shall be available to Owner and Engineer for inspection at any time . <br /> During construction , Contractor shall keep a marked - up and up-to date set of specifications <br /> showing as- is conditions on the site annotated to clearly indicate all substitutions or product selections <br /> that are incorporate into the work . These specifications shall be available to Owner and Engineer for <br /> inspection at any time . <br /> If at any time Contractor' s actual progress is inadequate to meet the requirements of the <br /> Contract, Owner may so notify Contractor who shall thereupon , at its expense , take such steps as may be <br /> necessary to improve its progress to meet the approved schedule . If within a reasonable period as <br /> determined by Owner, Owner determines that Contractor is not prosecuting its work with such diligence <br /> as will assure completion with the times scheduled , the Owner may declare a default of this Contract. <br /> GC 31 INSPECTION . <br /> Engineer: The Owner may provide Engineering personnel for the observation of the work . The <br /> Owner, Engineer and their representatives shall at all times have access to the work whenever it is in <br /> preparation or progress , and the Contractor shall provide proper facilities for such access and for <br /> inspection . If the specifications , the Engineer' s instructions , applicable laws , ordinances , or any public <br /> authority require any work to be specially tested or approved , the Contractor shall give the Engineer <br /> timely notice of its readiness for observation and , if the observation is by another authority than the <br /> Engineer, of the date fixed for such observation . If any work should be covered up prior to any quality <br /> inspection or test by Owner or Engineer, it must, if required by the Engineer, be uncovered for inspection <br /> and properly restored at the Contractor' s expense . <br /> GC 32 TESTING <br /> Unless otherwise provided in the Contract, drawings or specifications , shop testing of material or <br /> work shall be performed by the Contractor at its expense and in accordance with the technical <br /> specifications . Should tests in addition to those required by the specifications be desired by Owner, <br /> Contractor will be advised in reasonable time to permit such additional testing at Owner' s expense , <br /> unless additional tests are required due to Contractor' s work or materials having failed any initial test. <br /> Contractor shall furnish samples as requested and shall provide reasonable assistance and cooperation <br /> necessary to permit tests to be performed on materials or work in place , including reasonable stoppage of <br /> work during testing . <br /> GC 33 SUBSTITUTION . <br /> The naming of a specified product of specific manufacturers for equipment or materials under the <br /> various items of specifications or as shown on the plans shall be interpreted as establishing a minimum <br /> standard of quality and performance . It shall not be construed as eliminating the selection of other than <br /> the named equipment or materials equal to those specified , unless the materials are specifically <br /> designated as not permitting substitution . <br /> Prior to proposing any substitute item , Contractor shall satisfy itself that the item proposed is <br /> equal or better to that specified , that such item will fit into the space allocated , that such item <br /> affords <br /> comparable ease of operation , maintenance and service , that the appearance , longevity and suitability <br /> for the climate are comparable , that by reason of costs savings , reduced construction time or similar <br /> demonstrable benefit, the substitution of such item will be in Owner' s interest and will in <br /> no way <br /> detrimentally impact the project schedule . The burden of proof that such an item offered is equal in all <br /> respects to that specified shall be the Contractor' s . Contractor shall submit drawings , samples , data and <br /> additional information as may be required by Owner.
