(2) Issue variances from the standards of this <br />ordinance when all variance criteria are met. <br />Be Variance - The Board of adjustments may grant a <br />variance from the standards of this ordinance if the follow- <br />ing conditions are satisfied: <br />(1) The applicant meets the requirements of <br />Section 26 of the Indian River County Zoning Code, and <br />(2) Granting variance will not result in an <br />increase in the elevation of the Regulatory Flood, addition- <br />al threats to public safety, extraordinary public expense, <br />the creation of nuisances, fraud or victimization of the <br />public, or the creation of conflicts with other ordinances, <br />and <br />(3) No variance will be granted allowing a <br />development that would increase flood damage on other <br />property unless flowage easement have been obtained from the <br />owners of all affected property. In no case, however, will <br />a variance be granted that would increase the elevation of <br />the Regulatory Flood more than one foot. <br />Any applicant to whom a variance is granted shall <br />be given written notice specifying the exact nature of the <br />variance. <br />SECTION 13. NOTICE <br />A. In the event the Community Development Director <br />determines a violation exists, a written notice of violation <br />shall be issued to the owner of the property. The notice <br />shall contain: <br />(1) The name and address of the owner. <br />(2) The street address when available or a <br />description of the building or land upon which the violation <br />is occurring. <br />(3) A statement specifying the nature of the <br />violation. <br />(4) A description of the remedial actions neces- <br />sary to bring the development activity into compliance and a <br />time schedule for completion of such remedial action. <br />(5) A statement of the penalty or penalties that <br />may be assessed against the person to whom the notice of <br />violation is directed. <br />(6) A statement that the Community Development <br />Director's determination of violation may be appealed to the <br />Board of Adjustments by filing a written notice of appeal <br />within thirty (30) days of service of notice of violation. <br />Be The notice of violation shall be served upon the <br />person(s) to whom it is directed either personally, in the <br />manner provided for personal service of notices by the court <br />of local jurisdiction, or by mailing a copy of the notice of <br />
