ORDINANCE NO. 88 - 26 <br />b. Major site plan applicants, where right- <br />of-way deficiencies exist for right-of- <br />way abutting a project, shall dedicate at <br />a minimum the fair share of any right-of- <br />way needed to bring an abutting road <br />(local, collector, or arterial) right-of- <br />way up to local (minor) road standards as <br />defined in the Thoroughfare Plan. Said <br />dedications are deemed necessary to serve <br />the proposed development itself and shall <br />not be creditable for compensation. <br />2. Dedication of Thoroughfare Plan Road Right -of - <br />Way. <br />Any applicant for site plan approval for a <br />project abutting a roadway designated on the <br />County Thoroughfare Plan where the roadway has <br />a road right-of-way deficiency shall dedicate <br />sufficient land to make up his share of the <br />road right-of-way deficiency. The applicant <br />shall receive through traffic impact fee <br />credits, or residential density transfers, or <br />where the County chooses to pay cash, 100% <br />compensation for the value of the land area <br />dedicated for.road right-of-way, which exceeds <br />any area needed to bring the right-of-way up <br />to County local (minor) road standards. <br />a. Exemptions. <br />1. Where 100% compensation cannot be <br />provided through traffic impact <br />credit and density transfers, and <br />where the County chooses not to pay <br />cash, the applicant shall dedicate <br />an amount of land comparable in <br />value to the percent of compensation <br />provided and shall reserve the <br />balance of the right-of-way defi- <br />ciency; the location and configura- <br />tion of said dedication and reserva- <br />tion areas shall be approved by the <br />Public Works Director. <br />2. Where the applicant's project is <br />considered a minor site plan under <br />the terms of this ordinance, the <br />applicant may in lieu of dedication <br />reserve the land needed to make up <br />the right-of-way deficiency. <br />Any applicant for site plan approval for a <br />project abutting a public or private roadway <br />classified as a minor (local) road by the <br />terms of the County Thoroughfare Plan shall <br />dedicate sufficient land to make up his share <br />of the road right-of-way deficiency. There <br />shall be no compensation given for the dedi- <br />cation of minor (local) road right-of-way. <br />a.
