ORDINANCE NO. 94- 25 <br />ii the proposed improvements will <br />not preclude or reverse such <br />listing or eligibility; and <br />the proposed improvements are in <br />keeping with the historic <br />character and integrity of the <br />building and neighborhood. <br />2e the variance is the minimum necessary to <br />preserve the historic character and design <br />of the structure; and <br />3* every effort has been made to reduce future <br />flood damages without impairing the <br />historic character and design. <br />(c) Variances for other than historic buildings <br />shall be issued only upon: <br />1. a showing of good and sufficient cause; <br />29 a determination that failure to grant the <br />variance would result in exceptional <br />to the applicant <br />39 a determination that the granting of the <br />variance will not result in increase flood <br />heights, additional threats to public <br />safety, extraordinary public expense, <br />create nuisance, cause fraud on or <br />victimization of the public, or conflict <br />with existing local laws or ordinances; <br />49 a determination that the variance is the <br />minimum necessary to afford relief; and <br />5e a determination that the project design <br />includes all possible means for otherwise <br />reducing future flood damages. <br />(d) Variances shall not be issued to "correct" <br />violations, after -the -fact. <br />(e)_ Variances to reduce the floor elevation for.new <br />construction below the base flood elevation are <br />eligible only on sites as described in <br />Subsection 930.12(2)(a)3. <br />Conditions to mitigate adverse impacts of the <br />variance may be placed upon the granting of any <br />variance. <br />13Z Any applicant to whom a variance is granted <br />shall sign a written acknowledgement specifying <br />the difference between the base flood elevation <br />and the elevation to which the building is to be <br />built or substantially improved and stating that <br />the cost of flood insurance will be commensurate <br />with the increased risk resulting from the <br />reduced lowest floor elevation. <br />(h) The variance findings and conditions, together <br />with the signed acknowledgement form, shall be <br />recorded'. in the county public records and <br />Coding: Words in • • -•�• type are deletions from existing law. <br />Words underlined are additions. <br />22 <br />
