ORDINANCE N0. 93-30 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM IG TO <br />CG, FOR THE PROPERTY GENERALLY LOCATED ON THE EAST SIDE OF <br />10TH AVENUE, NORTH OF THE INTERSECTION OF 10TH AVENUE AND THE <br />F.E.C. RAILROAD TRACKS, AND DESCRIBED HEREIN, AND PROVIDING <br />FOR EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the <br />local planning agency on such matters, has held a public hearing <br />and subsequently made a recommendation regarding this rezoning <br />request; and <br />WHEREAS, the Board of County Commissioners of Indian River <br />County, Florida, did publish and send its Notice of Intent to <br />rezone the hereinafter described property, and <br />WHEREAS, the Board of County Commissioners has determined that <br />this rezoning is in conformance with the Comprehensive Plan of <br />Indian River County; and <br />WHEREAS, the Board of County Commissioners has held a public <br />hearing pursuant to this rezoning request, at which parties in <br />interest and citizens were heard, <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County <br />Commissioners of Indian River County, Florida, that the zoning of <br />the following described property situated in Indian River County, <br />Florida, to -wit: <br />The West portion of the plaza at Vero subdivision recorded on <br />Page 19-19A of plat book 12 in the Public Records of Indian <br />River County, Florida, less tracts "A", "B"', and "C" as shown <br />thereon said West portion being more particularly described as <br />follows: <br />Commence at the North one-quarter corner of section 12, <br />Township 33 South, Range 39 East, Indian River County, <br />Florida, then West 40.00 feet to a point on the West right-of- <br />way line of U.S. Highway No. 1; then south 00039148" West, <br />along said right-of-way line, 355.00 feet; then North <br />89043151" West, 400.00 feet; then North 00016109" East, 5.00 <br />feet; then North 89043'51" West, 187.30 feet to the point of <br />beginning of the herein described parcel of land, then South <br />00034128" West, 741.76 feet; then North 89030'45" West, 256.83 <br />feet; then North OOo42112" East, 370.28 feet; then North <br />89030'45" West, 234.94 feet; then North 00040'28" East, 157.31 <br />feet, then North 89043151" West, 174.34 feet to a point on the <br />East right-of-way line of 10th Avenue; then North 00034'28" <br />East along said right-of-way line, 212.30 feet; then South <br />89043151" East, 665.01 feet to the point of beginning, said <br />parcel containing 7.2 acres, more or less. <br />FROM A POINT OF BEGINNING AT THE INTERSECTION OF THE EAST <br />RIGHT-OF-WAY LINE OF THE FLORIDA EAST COAST RAILROAD AND THE <br />WEST FORTY LINE OF THE NORTHEAST QUARTER OF THE NORTHWEST <br />QUARTER OF SECTION 12, TOWNSHIP 33 SOUTH, RANGE 39 EAST, SAID <br />
