ORDINANCE NO. 2007-013 <br />user shall also repeat the sampling and analysis and submit the results of the repeat <br />analysis to the County Administrator within thirty, (30) days after becoming aware of the <br />violation. The user is not required to resample if the County Administrator monitors at <br />the user's facility at least once a month, or if the County Administrator samples between <br />the user's initial sampling and when the user receives the results of this sampling. <br />SECTION 20. CREATION OF NEW SECTION 201.78 OF THE CODE <br />Commencing on the Effective Date of this Ordinance, the following section is created to <br />read as follows: <br />Section 201.78. Notification of Discharge of Hazardous Waste. <br />(A) Any user is strictly prohibited from discharging any RCRA characteristic or listed <br />hazardous waste as defined under 40 CFR Part 261 to the POTW at any time. Any <br />user who may accidentally spill into the POTW any hazardous waste as defined in 40 <br />CFR Part 261 shall immediately notify the County Administrator verbally at the time of <br />the accident, followed by written notification to the County Administrator, the EPA <br />Regional Waste Management Division Director, and state hazardous waste authorities. <br />All written notifications shall be done within 24 hours of the spill or the accidental <br />discharge of hazardous waste into the POTW. All verbal and written notifications must <br />contain the following information to the extent such information is known and readily <br />available to the user: <br />(1) An identification of the hazardous constituents contained in the wastes; <br />(2) An estimation of the mass; and <br />(3) Concentration of such constituents in the waste stream discharged into the <br />POTW during the accidental discharge or spill. <br />(B) All verbal and written notifications shall be submitted every time an accident or a <br />spill leads to the discharge of hazardous constituents/hazardous waste into the POTW. <br />(C) The notification requirement in section 201.78 does not apply to pollutants already <br />reported by users subject to categorical pretreatment standards under the <br />self-monitoring requirements of this Part. . <br />(D) Section 201.78 concerning notification of discharge of hazardous waste applies to <br />all users regardless of the amount and concentration of hazardous waste discharged <br />into the POTW and whether or not the waste is just hazardous or the waste is acute <br />hazardous waste as specified in 40 CFR 261.30(d) and 261.33(e). <br />(E) In the case of any new regulations under Section 3001 of RCRA identifying <br />additional characteristics of hazardous waste or listing any additional substance as a <br />hazardous waste, the user must notify the County Administrator verbally, and in writing <br />to the County Administrator, the EPA Regional Waste Management Waste Division <br />Director, and State hazardous waste authorities, as set forth in section 201.78.A. upon <br />27 <br />
