Nonresident or temporary resident: Any owner of an animal regulated <br />II <br />by this chapter who does not reside within Indian River County for longer <br />than four (4) months out of any given year. <br />23. Officer: Any law enforcement officer, as defined in F.S. Serr!::ica: <br />_...................................................... <br />943.10, or any animal control officer. Owner: A person, firm, c�oration, or organization possessing, <br />harboring,_ keeping, or having control or custody of an animal or, if the <br />_. _....._..._.__ ... <br />_ <br />animal is owned by a person under the age of 18, that.. rson's parent or <br />guardian. Person: Any individual person, firm, partnership, corporation, <br />organization, other legal entity, or any combination thereof, however <br />organized, and every agent or employee thereof; any county and an.y local, <br />state or federal governmental agency. <br />26. Pet dealer: Any person that, in the ordinary course of business, <br />engages in the sale of more than two litters, or 20 dogs or cats, per <br />year, whichever is greater, to the public. This definition includes <br />breeders of animals who sell such animals directly to a consumer. [F.S. <br />v 828.29 (13)] <br />27. Proper enclosure of a dangerous dog: Means, while on the owner's <br />property, a dangerous dog is securely confined indoors or in a securely <br />enclosed and locked pen or structure, suitable to prevent the entry of <br />young children and designed to prevent the animal from escaping. Such <br />pen or structure shall have secure sides and a secure top to prevent the <br />dog from escaping over, under, or through the structure and shall also <br />provide protection from the elements. [ mmSr§ 767.11 (7) ] <br />28. Protection from the Elements: Provision of an accessible three <br />dimensional structure or area that: has a roof, and a minimum of three <br />(3) walls; is dry, weatherproof, and made of durable material; is <br />sufficient in size to allow the sheltered animal(s) to stand up, turn <br />around, and lie down comfortably; is designed to, and located on the <br />property in an area that will, protect the sheltered animal(s) from the <br />adverse effects of the heat and all other elements; is free from <br />accumulated animal waste and debris; protects the sheltered animal(s) <br />from injury; and has adequate ventilation. For the purposes of this <br />definition only, a wall shall be deemed to include a screen. <br />29. Public nuisance animal: Is any animal that: which: <br />a. Attacks passersby or passing vehicles without provocation; <br />b. Attacks other animals; <br />c. Is repeatedly at large -or not under restraint; <br />
