ORDINANCE NO. 2005-048 <br />S ection 403.23 Mechanical and Electrical Requirements. <br />(1) Scope. The provisions of this chapter shall govern the minimum mechanical and <br />e lectrical facilities and equipment to be provided. <br />(2) Responsibility. The owner of the structure shall provide and maintain <br />mechanical and electrical facilities and equipment in compliance with these <br />requirements. A person shall not occupy as owner -occupant or permit another person <br />to occupy any premises which does not comply with the requirements of this chapter. <br />S ection 403.24 Heating Facilities. <br />(1) Facilities required. Heating facilities shall be provided in structures as required <br />by this section. <br />(2) Residential occupancies. Dwellings shall be provided with heating facilities <br />capable of maintaining a room temperature of 68°F (20°C) in all habitable rooms, <br />bathrooms and toilet rooms based on the winter outdoor design temperature for the <br />locality indicated in the Florida Plumbing Code. Cooking appliances shall not be used to <br />provide space heating to meet the requirements of this section. <br />Exception: In areas where the average monthly temperature is above 30°F <br />(-1°C), a minimum temperature of 65°F (18°C) shall be maintained. <br />(3) Heat supply. Every owner and operator of any building who rents, leases or lets <br />o ne or more dwelling .unit, rooming unit, dormitory or guestroom on terms, either <br />expressed or implied, to furnish heat to the occupants thereof shall supply heat during <br />the period from November 1 to March 1 to maintain a temperature of not less than 68°F <br />(20°C) in all habitable rooms, bathrooms, and toilet rooms. <br />Exceptions: <br />1. When the outdoor temperature is below the winter outdoor design <br />temperature for the locality, maintenance of the minimum room temperature shall <br />not be required provided that the heating system is operating at its full design <br />capacity. The winter outdoor design temperature for the locality shall be as <br />indicated in the Florida Plumbing Code. <br />2. In areas where the average monthly temperature is above 30°F (-1°C) a <br />minimum temperature of 65°F (18°C) shall be maintained. <br />(4)_ Occupiable work spaces. Indoor occupiable work spaces shall be supplied with <br />heat during the period from November 1to March 1 to maintain a temperature of not <br />less than 65°F (18°C) during the period the spaces are occupied. <br />Coding: Words underscored are additions to text words in strikethrough format are <br />deletions to text. <br />20 <br />
