AUG 221973 <br />and.Board of County Commissioners to defer action on said <br />tezoning requests until a comprehensive master plan was for- <br />mally adopted. <br />(13) Regardless of said petition and request; the Indian <br />River County Zoning Board recommended approval of at least one <br />such rezoning application and further threatens -to recommend <br />approval of other similar rezoning applications; that the Indian <br />River County Board of County Commissioners threatens to approve <br />the rezoning sought on at least one such application at its meeting <br />on August 22, 1973, and further threatens to approve similar re- <br />zoning applications; that, in view of the petitions and requests <br />made by plaintiffs, members of the Vero Beach Association, through <br />its Board of Directors, it is plaintffs' belief that to exhaust <br />their administrative remedies by further petitions and requests of <br />the same nature would be a vain act. <br />(14) On -or ab*u -: ,C/;? �3, Indian River County, by and <br />through its County Commissioners, held a public hearing following <br />notice duly published for the purpose of considering and approving <br />an Ordinance affecting the property surrounding State Road 60 in <br />Indian River County, Florida; that said Ordinance (No. 72-3) was <br />adopted in accordance with the formalities required for the adoption <br />of Ordinances; that concurrent with the adoption of said Ordinance, <br />zoning districts which might conflict with or might be inconsis- <br />tent with the comprehensive master plan as ultimately adopted were <br />rezoned into holding districts pending adoption of a comprehensive <br />master plan; and that said Ordinance was extended on or about March <br />8, 1973. <br />(15) That on more than one occasion, beginning on or about • <br />December of 1972, defendant's planner had.reported to the Board of <br />County Commissioners that the City Planning Commission had completed <br />its study and that a final recommended composite master plan has been <br />Page Four. <br />- 25 - <br />7 PMfr F/y/2 <br />
