Comprehensive Plan Coastal Management Element <br />1. The siting of new boat facilities, or the expansion or slip conversion of <br />existing boating facilities shall be prohibited in the following areas of Indian River <br />County <br />• All of the St. Sebastian River west of the U.S. 1 Bridge; and <br />• All of the Pelican. Island National Wildlife Refuge. <br />2. The siting of new boat facilities, or the expansion, slip conversion or <br />rearrangement of existing boating facilities, shall be prohibited in the following <br />areas: <br />• Within the Town of Orchid; <br />• Within the Town of Indian River Shores; <br />• Within the area known as the Jungle Trail Narrows; and <br />• Within any area designated as both a High Manatee Use area and a High <br />Watercraft -related Manatee Mortality area, as defined in the MPP. <br />Exceptions: The siting of new residential marinas, or the expansion, rearrangement <br />or slip conversion of existing residential marinas, may be allowed in the prohibited <br />areas identified in this Policy Subsection 3 2 2 under the following conditions: <br />a. The proposed new or expanded residential marina is in lieu of single-family <br />docks that could otherwise be built through riparian rights at riverfront lots within <br />the development served by the residential marina, and the residential marina will <br />result in less environmental impact than the alternative single-family docks, <br />provided the residential marina will not breach the 1:100 powerboat slip to linear - <br />foot shoreline ratio set forth in Policy 3.14. Under this section, an applicant for a <br />new or expanded residential marina in lieu of single-family docks shall be <br />required to record a conservation easement, in favor of the County or the State, <br />along the shoreline of the riverfront lots that would otherwise be eligible for <br />single-family docks. <br />b. Slip conversions of existing boat facilities maybe allowed on a one-time basis at <br />a density of 1.5 total powerboat slips per 100 feet of shoreline if the facility is not <br />located in an area of high manatee use and high manatee mortality based on the <br />definitions and criteria m the MPP, and if the powerboat to shoreline restriction <br />has been in place prior to July 1993, when the countywide speed zone rule was <br />posted. <br />c.
