Comprehensive Plan Coastal Management Element <br />In the event that all the required or necessary dredging is determined by the FDEP <br />or the SJRWMD to be maintenance dredging then this subsection [3(c)] does not <br />apply. The determination of maintenance dredging shall be made in writing by <br />the FDEP or SJRWMD and submitted to County Planning staff. It is the <br />responsibility of the applicant, the property owner, or developer to secure this <br />written documentation. If any of the required or necessary dredging is <br />determined to not be maintenance dredging (i.e., new dredging) then that part of <br />the proposed project involving the proposed new dredging and any other activity <br />or structures associated with the proposed new dredging, is prohibited. <br />4. The siting of new or the rearrangement or expansion of existing boat ramps <br />shall be evaluated using all the following criteria: <br />(a) No more than 100 linear feet of native shoreline vegetation shall be <br />altered (trimmed, cut, removed, killed, or destroyed); <br />(b) A site located within a High Manatee Use area, OR a High <br />Watercraft -related Manatee Mortality area, as defined in this MPP shall be <br />subject to site-specific design restrictions to minimize potential adverse <br />manatee impacts, including (but not limited to): restrictions on the total <br />number of boat lanes allowed; restrictions on the maximum size of boats that <br />use the boat ramp; limitations on the size of boat trailer parking spaces; <br />limitations on the depth of the boat ramp and/or the ingress — egress channel, <br />posting of informational signs; installation of navigational aids; re -design of <br />the boat ramp; and/or reduction in the size of the boat ramp. <br />(c) Maintenance dredging, as determined in writing by the FDEP or the <br />SJRWMD, shall be restricted to those areas where maintenance dredging has <br />been determined and shall conform to one of the following situations using <br />the order in which the situations are presented: <br />i. The dredging shall conform with the original dredging permit <br />specifications, if one was issued; <br />ii. The dredging shall conform with the original design specifications, if <br />the existingproject was done prior to the issuance of permits required <br />by federal, state, or local government entities; <br />iii. The dredging shall be no deeper than to a maximum water depth of <br />five (5) feet at mean low water, and no wider, at the top of the <br />submerged bottom, than to safely allow the passage of two boats side- <br />by-side, the size of which the boat ramp was/is designed to <br />Indian River County Coastal Management Element Page 106 <br />Supplement # Ordiance #2005-_ Adopted 2005 Exhibit B Page /q <br />
