ORDINANCE NO. 2008 <br />EXHIBIT "B" <br />Public Benefits: <br />For all PD projects, applicants must identify the public benefits that the project will provide in <br />exchange for the county approving requested waivers. For Liberty Park, the public benefits <br />are as follows: <br />EMI <br />Elementary School Site: The developer dedicated the 18.89 acre Liberty Magnet <br />School site without compensation in advance of project consideration. In addition to <br />the site, drainage, paving, and landscape upgrades for the school were provided by the <br />developer. The school is now open and operational. <br />County Park: (Ryall Park) The applicant will dedicate a 58.92 acre site at the <br />northeast corner of 66th Avenue and 81st Street as a county park. The site will also <br />provide stormwater treatment for the CR510 widening project. The applicant will <br />dedicate the site with the final plat for phase 1. Prior to a certificate of completion for <br />phase 11, the applicant will construct park improvements on the site including play <br />fields, packing landscaping and bathrooms. The developer will also pave 81st Street <br />from 66th Avenue to the park entrance. With the final plat, the developer will dedicate <br />a 12 acre conservation area for native uplands and wetlands at the north end of the <br />park. <br />12th Street Public Use Site: The developer will dedicate 18.90 acres at the southeast <br />corner of 1 2th Street and 58th Avenue for public use. This parcel will be graded and <br />grassed, and improved with access, then dedicated to the county for park or other <br />public uses prior to or via the phase II1 final plat. <br />Indian River Blvd Conservation Area: The developer will place conservation <br />easements over two adjacent parcels that lie just east of Indian Rivet Blvd on the north <br />side of 37th Street. There is a 15.64 acre parcel that is in the County and a 41.2 acre <br />parcel in the City of Vero Beach. County staff has coordinated with the city <br />community development director who has indicated that the proposed density transfer <br />and conservation easement are consistent with city policies and regulations. While <br />maintaining ownership of the parcels, the developer will place conservation easements <br />over these two parcels that will prohibit residential use of the parcels and restrict the <br />density to zero. The conservation easements will need to be established prior to or via <br />the recording of the final plat phase 1 to both -Indian River Blvd sites. The developer <br />may use the parcels as a mitigation bank. <br />' Breezy Village" Conservation Area: This 40.2 acre parcel is located just west of <br />the Breezy Village mobile home par k at the west end of 99th Street. While the <br />developer will retain ownership of and maintenance responsibilities for the parcel, the <br />developer will establish a conservation easement over this parcel prohibiting <br />residential use and restricting the density to zero. In addition, the site will be rezoned <br />to PD at zero density, and the developer will remove exotics from the site to enhance <br />the conservation area. The conservation easement will need to be established prior to <br />or via the final plat for phase 1.
