ORDINANCE NO. 2007- 002 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING <br />ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR ± 1.81 ACRES <br />LOCATED ON THE SOUTHEAST QUADRANT OF THE INTERSECTION OF <br />U.S.HIGHWAY 1 AND 45TH STREET, FROM CH, HEAVY COMMERCIAL DISTRICT, <br />TO CG, GENERAL COMMERCIAL DISTRICT; AND PROVIDING CODIFICATION, <br />SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency <br />on such matters, held a public hearing and subsequently made a recommendation regarding this <br />rezoning request; and <br />WHEREAS, the Board of County Commissioners of Indian River County, Florida, did <br />publish and send its Notice of Intent to rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners held a public hearing pursuant to this <br />rezoning request, at which parties in interest and citizens were heard; <br />WHEREAS, the Board of County Commissioners has determined that this rezoning is in <br />conformance with the Comprehensive Plan of Indian River County; and <br />NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of <br />Indian River County, Florida, that the zoning of the following described property situated in <br />Indian River County, Florida, to -wit: <br />A PORTION OF LAND IN SECTION 26, TOWNSHIP 33 SOUTH, RANGE 39 EAST, <br />INDIAN RIVER COUNTY, FLORIDA, WHICH IS MORE PARTICULARLY DESCRIBED <br />AS FOLLOWS: <br />FROM A POINT OF BEGINNING LYING 420.00 FEET WEST AND 387.38 FEET SOUTH <br />OF THE NORTHEAST CORNER OF THE NORTHWEST '/4; RUN WEST AND PARALLEL <br />TO THE NORTH LINE OF SECTION 26 A DISTANCE OF 208.53 FEET TO THE EAST <br />RIGHT OF WAY (R/W) LINE OF US HIGHWAY #1; THENCE NORTH 11°57'00" WEST <br />ALONG SAID R/W 314.15 FEET TO A POINT OF RADIAL TURN ON N.
