GEORGIA 30309 ' <br />December 11, 1973 <br />Honorable Alma Lee Loy <br />Chairman, Indian River County Commission <br />Indian River County Courthouse <br />Indian River Shores, Florida 32960 <br />Dear Mrs. Loy: <br />A technical, legal, and administrative review has been <br />performed on the contracts submitted by Vero Beach, Indian <br />River County, and Indian River Shores. <br />From a legal point of view, there appears to be no <br />problem. Our technical staff has given their conditional <br />approval with some reservations as follows: <br />1. The Vero Beach plant was designed to accommodate <br />the community of Indian River Shores. If Indian <br />River Shores should ever require services by <br />Vero Beach and be refused, this action could <br />provide grounds for termination or recovery of <br />the Vero Beach grant. <br />2. It should be understood that in the event that <br />Indian River Shores does, in fact, construct <br />their own facility, it must be done so without <br />EPA funds. Funds could only be -expended to <br />implement the'approved plan or any other amended <br />version of the plan which may be approved by EPA. <br />It must be understood that this approval in no way <br />obviates the grantees from their responsibility to fulfill <br />all terms and conditions of the existing grant. <br />If we may be of further assistance, please do not <br />hesitate to call on us. <br />Sincerely yours, <br />i <br />Bernard M.
