SECTION II. NEW PART III <br />Sections 303.16 through 303.27 of the Indian River County Code are hereby placed in a <br />new Part III of Chapter 303 to be entitled "Pollutant Interceptors and Grease Traps" <br />SECTION III. NEW PART IV <br />Section 303.28 of the Indian River County Code is hereby placed in a new Part IV of <br />Chapter 303 to be entitled "Electrical Transmission Lines" <br />SECTION IV. NEW PART V <br />Part V of Chapter 303 Indian River County Code is hereby adopted to read as follows: <br />Section 303.29 Purpose <br />The Board of County Commissioners of Indian River County, Florida, wishes to protect <br />the health and environment of its citizens, and recognizes that certain risks to the public health <br />and environment may be associated with the demolition of structures within the County. <br />Accordingly, the Board wishes to provide a mechanism to assure that demolition hazards are <br />identified and addressed. <br />Section 303.30 Definitions <br />All definitions contained in The Indian River County Land Development Code, Chapter <br />901, and in Chapter 85-427, Special Acts, Laws of Florida, are hereby adopted by reference. In <br />addition, the following terms shall have the following meanings: <br />a. "Demolition" shall mean demolition of a structure or renovation of a structure if <br />the renovation involves the removal of used building materials from the structure <br />and would require a building permit. <br />b. `Environmentally stabilized" shall mean cleaned out, filled with inert material, <br />and made structurally sound. <br />C, "Underground storage tank" shall mean any underground tank used at any time to <br />store petroleum or other materials. <br />d. "Applicable law" shall mean any laws, rules, regulations, codes, or ordinances <br />applicable to the activity. <br />e. "Health Department" shall mean the Indian River County Health Department, <br />Section 303.31 Exempt Structures <br />This Ordinance shall not apply to the demolition of any structure, the construction of <br />which would not require a building permit under applicable laws. <br />F:\Attorney\Lea\DOCS\ORD\demolition health deptinspect Ord tpo suz.doc 2 <br />
