b. If septic tanks are found to be present, they shall be properly abandoned by a <br />licensed septic tank contractor in accordance with the provisions of Chapter 64E- <br />6, Florida Administrative Code, unless the applicant demonstrates to the Health <br />Department that the septic tank is in good condition and demonstrates that it is the <br />applicant's intention to connect the septic tank to a structure within the next six <br />months. <br />c. If underground storage tanks are found to be present, they shall be properly <br />removed and disposed of or abandoned in place, in accordance with the <br />provisions of applicable law. In the absence of other applicable law, the tanks <br />shall be environmentally stabilized in place. <br />d. If asbestos is discovered or if the Health Department has reason to believe that <br />asbestos may be present, the applicant shall retain the services of a licensed <br />asbestos surveyor to inspect the premises, and, if required, a licensed asbestos <br />contractor to remove any asbestos in accordance with applicable law. <br />e. If potable or irrigation wells are found, they shall be abandoned in accordance <br />with applicable law, unless the applicant demonstrates to the Health Department <br />that the well is in good condition, in which case it may be capped in accordance <br />with the provisions of the Florida Administrative Code. <br />f. All other materials listed in Section 303.34 above shall be removed and disposed <br />of in accordance with applicable law. <br />Section 303.37 Requirements for Demolition <br />The Health Department <br />shall require the following as <br />a condition <br />of any demolition <br />Section 303.39 Coordination <br />With <br />Building <br />Departments <br />issued: <br />approval <br />a. Compliance with the requirements of this Ordinance, and <br />b. Proper disposal of all materials in accordance with applicable law, and <br />c. Submission of documentation evidencing proper disposal of all materials removed <br />from the site within ten business days of said removal. <br />d. Compliance with the requirements of Chapter 469, Florida Statutes, and Chapter <br />62-257, Florida Administrative Code, pertaining to asbestos. <br />Section 303.38. Enforcement <br />This Part may be enforced by the Indian River County Health Department and the Indian <br />River County Environmental Control Officer in the manner set out in Chapter 85-427, Special <br />Acts, Laws of Florida, or may be enforced as any County ordinance, including but not limited to <br />enforcement by the Board of County Commissioners seeking injunctive relief. <br />The Health Department shall coordinate with the various building departments to <br />simplify and facilitate the procedures for applicants. <br />Section 303.40 Penalties <br />F:\Attorney\Lea\DOCS\ORD\demolition health dept inspect ord tpo suz.doc 4 <br />Section 303.39 Coordination <br />With <br />Building <br />Departments <br />The Health Department shall coordinate with the various building departments to <br />simplify and facilitate the procedures for applicants. <br />Section 303.40 Penalties <br />F:\Attorney\Lea\DOCS\ORD\demolition health dept inspect ord tpo suz.doc 4 <br />
