SOLID WASTE DISPOSAL DISTRICT <br />RESOLUTION NO.SWpp 94-1 <br />A RESOLUTION OF THE BOARD OF COMMISSIONERS <br />OF THE SOLID WASTE DISPOSAL DISTRICT <br />REVISING AND REpLACTNG RESOLUTION <br />NO. 92'1 PROVIDING DEFINITIONS AND CHANGES <br />TO DEFINITIONS; GRANTING AN EXCLUSIVE <br />FRANCHISE FOR SOLID WASTE COLLECTION SERVICE <br />AND RECYCLING LOLL CTmN SERVTr"R PROVIDING <br />FOR SEPARATE RESIDENTIAL YARD TRASH <br />COLLECTION; PROVIDING CONTRACTUAL AGREEMENT <br />FOR RESIDENTIAL RECYCLING SERVICE TO TNCLUD£ <br />RECYCLING COLLECTION SERVICE TO MULTIPLE <br />DWELLING UNITS ANn MOBILE HOME PARKS* <br />ESTABLISHING MINIMUM PERFORMANCE <br />REQUIREMENTS; ESTABLISHING RATES AND <br />BILLING PROCEDURES; ESTABLISHING SERVICE <br />AREA BOUNDARIES; AND PROVIDING AN EFFECTIVE <br />DATE. <br />WHEREAS, the Board of County Commissioners of Indian River <br />County, Florida, pursuant to Chapter 59-1380 Special Acts, Laws <br />of Florida, granted a solid waste collection service Franchise <br />to Harris Sanitation, Inc. (here -in -after called "COLLECTOR") <br />and, <br />WHEREAS, pursuant to Chapter 125, Florida Statutes, the <br />County is authorized to franchise and contract for solid waste <br />collection and disposal services, and <br />WHEREAS, pursuant to Chapter 125, Florida Statutes, and <br />under the provisions of County Ordinance 87-67, the County <br />created the Solid Waste Disposal District (here -in -after called <br />S.W.D.D.I as a dependent special district to provide an <br />efficient and acceptable means, funded in an equitable manner, <br />for the disposal of solid waste, and <br />WHEREAS, pursuant to County Ordinance 87-67, the S.W.D.D. <br />has the authority to accomplish the purposes of the District by <br />contract, and <br />WHEREAS, the collection of solid waste is an integral part <br />of the disposal of solid waste, and <br />WHEREAS, the franchising of solid waste collection services <br />within the service area of the S.W.D.D., and any contracts for <br />residential recycling services within the service area of the <br />HSFRAN93.DOC <br />-1- <br />Language underlined is Adde <br />Language stricken is Delete <br />
