_ 12/8/ 8 7. 1 (Or d) LEGALIA&A-TP <br />ORDINANCE NO. 87- 67 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, <br />CREATING A DEPENDENT SPECIAL DISTRICT WITH THE <br />BOARD OF COUNTY COMMISSIONERS AS THE GOVERNING <br />BODY FOR PROVIDING A SANITARY LANDFILL OR OTHER <br />MEANS FOR THE DISPOSAL OF ALL SOLID WASTE <br />GENERATED WITHIN THE SPECIAL DISTRICT BOUNDARIES, <br />WHICH INCLUDE THE ENTIRE UNINCORPORATED AREA AND <br />MUNICIPALITIES WHICH VOLUNTARILY JOIN; PROVIDING A <br />METHOD FOR OBJECTING TO DISPOSAL CHARGES AND <br />CREATING AN ADJUSTMENT BOARD; PROVIDING A <br />PROCEDURE FOR THE CLASSIFICATION OF ALL PROPERTY <br />WITHIN THE DISTRICT AND THE IMPOSITION OF AN <br />ANNUAL DISPOSAL CHARGE AGAINST ALL ASSESSABLE <br />PROPERTY BASED UPON SUCH CLASSIFICATION; PROVIDING <br />THAT THE DISPOSAL CHARGE BE INCLUDED ON THE ANNUAL <br />AD VALOREM TAX BILL SENT BY THE COUNTY TAX <br />COLLECTOR; PROVIDING THAT THE DISPOSAL CHARGE <br />SHALL CONSTITUTE A LIEN AGAINST ALL SUCH PROPERTY; <br />PROVIDING CRITERIA AND PROCEDURES FOR RATE <br />CHANGES. <br />BE IT ORDAINED by the Board of County Commissioners of <br />Indian River County that: <br />SECTION 1. CREATION OF DEPENDENT SPECIAL DISTRICT FOR <br />------------------------------------------------------ <br />SOLID WASTE DISPOSAL, COMPOSITION OF DISTRICT, GOVERNING <br />------------------------------------------------------------ <br />BODY <br />Pursuant to the authority granted by §125.01(5)a, <br />Florida Statutes, there is hereby created a dependent <br />special district to be called the Solid Waste Disposal <br />District ("SWDD" or "district") for the purpose of providing <br />an efficient and acceptable means funded in an equitable <br />manner for the disposal of solid waste generated by the <br />residents of the district or county. The district shall be <br />composed of the entire unincorporated area of Indian River <br />County and those municipalities in Indian River County which <br />voluntarily join the district through approval of their <br />governing body pursuant to law. The governing body of the <br />district shall be the Board of County Commissioners. <br />SECTION 2. AUTHORITY FOR FUNDING OF DISTRICT <br />------------------------------------------- <br />The district shall be authorized to operate from funds <br />derived from special assessments levied against improved <br />real property ("assessable property") within the district <br />and service charges and fees, pursuant to the procedures of <br />this ordinance and general law. <br />
