CHRISTOPHER HARBOR SUBDIVISION, SUBJECT TO <br />AN ADDITION OF 15 FOOT UTILITY EASEMENT ON THE SOUTH SIDE <br />OF ISLAND DRIVE AND THE NORTH SIDE OF HARBOR LANE, AS IT <br />EXTENDS TO STATE ROAD MA, TO BE USED FOR FUTURE PUBLIC <br />UTILITIES AND ALSO SUBJECT TO THE RECEIPT OF A DEED FOR THE <br />ADDITIONAL 20 FEET OF RIGHT-OF-WAY ON STATE ROAD AlA. <br />MARVIN CARTER, SURVEYOR APPEARED REQUESTING FINAL <br />APPROVAL OF ANGLERS COVE SUBDIVISION, UNITS 1 AND Z. <br />ON MOTION BY COMMISSIONER SIEBERT, SECONDED BY <br />COMMISSIONER MASSEY, THE BOARD UNANIMOUSLY GRANTED FINAL <br />APPROVAL TO ANGLER'S COVE SUBDIVISION, UNITS 1 AND 21 <br />SUBJECT TO "PRIVATE ROADS AND OR UTILITY EASEMENT" BEING <br />ADDED TO THE PRIVATE ROAD DEDICATION. <br />RICHARD NEILL, ATTORNEY, REPRESENTING INDIAN RIVER <br />COUNTY IN A LAW SUIT FILED BY DON WILCOX OF EISWELL CORPORATION <br />APPEARED AND GAVE THE BOARD A STATUS REPORT REGARDING THIS LAW <br />SUIT AND TO OBTAIN THE BOARD'S APPROVAL TO FILE A MOTION FOR TRIAL. <br />MR. WILCOX IS SUING THE COUNTY IN AN ATTEMPT TO GET <br />THE COURT TO REZONE SOUTH BEACH PROPERTY TO MULTIPLE ZONING <br />.USE. MR.NEILL STATED THAT MR. WILCOX, THE OWNER OF THE <br />PROPERTY, HAS OFFERED A SETTLEMENT PROPOSAL OF A 150 FOOT BUFFER <br />ZONE OF SINGLE FAMILY RESIDENCE ALONG THE SOUTH BOUNDARY OF <br />HIS PROPERTY, <br />THIS PROPERTY IN QUESTION IS BOUNDED ON THE NORTH AND <br />SOUTH BY SINGLE FAMILY ZONING. <br />DISCUSSION FOLLOWED AND MR. NEILL STATED THAT HE <br />ESTIMATED THE COST OF TAKING THE CASE TO TRIAL WOULD BE <br />$5,000 - $10,000 AND STATED THAT NO MATTER WHO WINS THE <br />DECISION PROBABLY WOULD BE APPEALED INVOLVING ADDITIONAL <br />LEGAL COST, <br />12 <br />
