STATES THAT IN ORDER TO RECEIVE A SPECIAL <br />EXCEPTION PERMIT,•A PERSON MUST HAVE OWNED HIS PROPERTY BEFORE <br />DECEMBER 8, 1973. <br />ATTORNEY COLLINS REVIEWED MRS. JOHNSON'S DEED TO HER PROP— <br />ERTY AND STATED.THAT HE HAS SOME DOUBT THAT IT IS A CLEAR TOILE TO <br />HER PROPERTY AND SUGGESTED TO MRS. JOHNSON THAT SHE BRING THIS TO <br />THE ATTENTION OF HER ATTORNEY. THE MAJOR PORTION OF THIS PROPERTY <br />IS ZONED COMMERCIAL, AND MRS. .JOHNSON WILL ALSO HAVE TO OBTAIN A' <br />ZONING CHANGE, <br />THE BOARD AGREED THAT A SPECIAL EXCEPTION COULD NOT BE <br />GRANTED FOR THE FOLLOWING REASONS: <br />1. A PORTION OF MRS. .JOHNSON'S PROPERTY IS ZONED COMMERCIAL. <br />AND WILL HAVE TO BE REZONED. <br />2. A SPECIAL EXCEPTION PERMIT CANNOT BE GRANTED BECAUSE IT DOES <br />NOT COMPLY WITH ORDINANCE 74-20. <br />3. THERE IS QUESTION AS TO THE LEGALITY OF THE TITLE, <br />THE BOARD DISCUSSED .JIM WALTERS CORPORATION, WHO ARE -BUILDERS <br />WORKING THROUGHOUT INDIAN RIVER COUNTY. <br />DEWEY WALKER STATED THAT THIS CORPORATION IS -INVOLVED IN THE <br />BUILDING OF HOUSES. THEY BUILD THE FRAMEWORK, OR WHATEVER PORTION <br />OF THE HOUSE YOU MAY WANT BUILT, THEN THE OWNER FINISHES THE HOUSE <br />AND IT IS IN -THIS AREA THAT THERE -ARE PROBLEMS. -OWNERS ARE NOT <br />FINISHING HOUSES ACCORDING TO THEIR SITE PLANS OR BUILDING SPECIFI- <br />CATIONS. <br />THE BOARD QUESTIONED IF THIS CORPORATION IS AWARE OF OUR <br />REGULATIONS. DEWEY WALKER STATED THAT HE DOES TRY TO KEEP THEM <br />INFORMED OF OUR ORDINANCES, BUT THEY HAVE A GREAT TURNOVER OF -SALES <br />PERSONNEL. <br />THE BOARD INSTRUCTED ATTORNEY COLL/NS TO WRITE A LETTER TO THE <br />.JIM WALTERS CORPORATION, AFTER CHECKING WITH DONALD -ADAMS, BUILDING <br />DIRECTOR, IN REGARD TO COUNTY ORDINANCES. <br />ON MOTION BY COMMISSIONER SIEBERT, SECONDED BY COMMISSIONER <br />WODTKE, THE BOARD UNANIMOUSLY ADOPTED A PROCEDURE FOR THE DEVELOPMENT <br />OF KIWANIS—HOBART PARK AS OUTLINED IN THE FOLLOWING MEMORANDUM FROM <br />6- <br />8aoi( 22 PAGE 52 <br />
