Planning activities, through the State's Department of Community <br />Affairs. <br />It appears that the Department of Community Affairs (DCA) <br />was empowered to process local community applications for 701 <br />funds by Part I of Chapter 163. It is not explicitly clear <br />whether this power was limited solely to activities authorized <br />by Chapter 163, but since the power was granted by this Chapter, <br />and absent other authority or a definitive ruling to the con- <br />trary, it would seem that the power may be so limited. In other <br />words, while Chapter 21310 empowered the County to engage in <br />zoning pursuant to a comprehensive plan, and Chapter 125 later <br />empowered the County to engage in such planning and toenter <br />into agreements with other governmental agencies relating there- <br />to, neither of these chapters specifically empowered the County <br />to apply for and receive 701 funds for such planning activities. <br />Under Chapter 163, Part II, Sections 163.175, 163.180, <br />163.190, 163.195, 163.200 and 163'.205 the City and County would <br />be empowered to "jointly exercise the powers granted under this <br />part" as follows: <br />(1) By formal adoption, following a public hearing, <br />of a joint agreement to so do. <br />(2) Following such agreement, they. would be empow- <br />ered to establish a joint planning commission <br />pursuant to such an agreement, but elected <br />officeholders could serve on the commission <br />only in an ex officio capacity (As we have seen, <br />a joint planning commission was created, but <br />its principal members are elected or appointed <br />officeholders - from the County; Chairman of <br />Board of County Commissioners, County Adminis- <br />trator, Chairman of County Zoning Commission - <br />from the City; the Mayor, the City Manager and <br />the Chairman of the Parks, Planning and Zoning <br />Commission). Under this Chapter, the Commission <br />was to gather information, hold public hearings <br />and develop a comprehensive plan. (As will be <br />seen later, our joint planning commission did <br />not engage in these activities, but delegated <br />them to the planning department and a planning <br />consultant.) <br />The final comprehensive plan, following public <br />hearing and adoption by the planning commis- <br />sion was to be certified the commission to <br />(3) <br />JUN 4 1975 <br />22-3- <br />gnat 2a Gs 1. ;� <br />
