P <br />JUN 4in <br />As information was gathered and the plan developed by <br />Adley and the planning department, it was independently con- <br />sidered at numerous workshops of City and County zoning com- <br />missions respectively. While these workshops were open to <br />the public, they were not usually characterized as public <br />hearings or meetings. Indeed, at many such workshops, public <br />input was excluded. The only public meetings that were sched- <br />uled for and noticed to the general public were on October 3, <br />1973 (for the unincorporated portion of the County plan), and <br />on January 31, 1974 (for the City portion of the plan). <br />The City portion of the plan was finally referred by the <br />planning department to the City's Parks, Planning and Zoning <br />Commission who, in turn, recommended it to the City Council <br />for adoption with an implementing Ordinance No. 1250 which <br />was passed by the City Council on February 4, 1975. That <br />Ordinance (copy enclosed as Exhibit B) is generally consist- <br />ent with the requirements of Chapter 163. <br />The unincorporated County portion of the plan was simi- <br />larly referred by the planning department to the County Zoning <br />Commission who, in turn, have recommended it to the County <br />Commission with an implementing Ordinance (copy enclosed as <br />Exhibit C) which does not conform to the requirements of <br />Chapter 163. This matter is scheduled for public hearing <br />before the County Commission for May 29, 1975. <br />The proposed County Ordinance does not conform in that <br />it does not restrain zoning and land use which is inconsist- <br />ent with the plan and does not require zoning and land use to <br />conform to the plan (subject to the safeguards of public <br />hearings and annual review of the plan). As a consequence, <br />we had proposed a substitute Ordinance (copy enclosed as <br />Exhibit D) which was more consistent with the City's Ordi- <br />nance and with the requirements of Chapter 163. However, the <br />County Zoning Commission rejected our proposal in favor of <br />the ordinance they are now recommending to the County Commis- <br />sion. The difference between the two proposals is the dif- <br />ference between having a plan which has no controlling force <br />and effect and one which can control growth in accordance <br />with the plan. In our view, if you don't have the latter, <br />the expenditure of time, effort and money in developing the <br />plan has been for naught. <br />-5- <br />3F)Pt. <br />3 <br />
