NOW, THEREFORE, in consideration of the sum of Ten <br />Dollars ($10.00) and other valuable considerations, the receipt <br />whereof is hereby acknowledged, and the mutual promises and under- <br />takings herein contained, it is agreed as follows: <br />1. RALMAR does hereby agree that it will service all <br />of the property, above described, owned by TEN COINS and TALBERT <br />with its sewer services under its franchise known as TREASURE <br />COVE SUBDIVISION SEWER FRANCHISE granted by the Indian River County, <br />Florida Board of County Commioners by virtue of Resolution No. 75-21 <br />on April 23,. 1975. <br />2. TEN COINS agrees to pay all expenses incident to <br />obtaining an amendment to the franchise area, this Agreement, and <br />all other legal, engineering, and incidental costs required to <br />bring the TEN COINS and TALBERT properties into the franchise area, <br />and to plan and construct facilities to service the TEN COINS and <br />TALBERT properties, and to tie the same into a force main owned <br />by RALMAR. <br />3. RALMAR agrees to apply for an amendment to the <br />franchise area to include the above-described property within the <br />franchise on behalf of TEN COINS and TALBERT. <br />4. It is understood and agreed that TEN COINS and <br />TALBERT shall be bound by all provisions of Resolution No. 75-21, <br />TREASURE COVE SUBDIVISION SEWER FRANCHISE, dated April 23, 1975, <br />and they further agree to abide by all provisions thereof, as will <br />be the case with all other recipients of the sewer service to be <br />provided by RALMAR under its franchise in the total franchise area. <br />5. It is further understood and agreed that upon <br />construction of the sewer pipes and other required facilities, <br />that the same shall become the property of RALMAR under its fran- <br />chise agreement and TEN COINS and TALBERT agree to execute any <br />and all documents to accomplish the same. <br />-2- <br />SEP 2 41975 <br />Book • J t 451 <br />
