1 <br />RESOLUTION NO. 2003- 103 <br />A RESOLUTION OF INDIAN RIVER COUNTY, <br />FLORIDA, DELEGATING TO THE COMMUNITY <br />D EVELOPMENT DIRECTOR OR HIS DESIGNEE <br />AUTHORITY TO EXECUTE RELEASES <br />P ERTAINING TO ACCESSORY DOCK <br />AGREEMENTS WHERE A CERTIFICATE OF <br />OCCUPANCY HAS BEEN ISSUED FOR A <br />P RINCIPAL RESIDENCE. <br />WHEREAS, current land development regulations allow property owners to <br />construct and use an accessory dock prior to construction of a principal residence <br />provided, however, that the property owner enter into an accessory dock agreement; <br />and <br />WHEREAS, one of the conditions in the accessory dock agreement is that use of <br />the dock facility must cease within three years of the issuance of the dock building <br />permit unless a certificate of occupancy is issued for the principal residence; and <br />WHEREAS, when a certificate of occupancy has been issued for the principal <br />residence, a release of the recorded accessory dock agreement is an administrative <br />function that can be delegated by authority of the Board of County to the Community <br />Development Director or his designee; <br />1 <br />F:\attorney\nancy\DOCS\RES\Reso autho cdd to execute releases for accessory dock.doc <br />/i" 03 <br />K. <br />
