RESOLUTION NO. 2004- 132 <br />RESOLUTION OF THE INDIAN RIVER COUNTY BOARD <br />OF COUNTY COMMISSIONERS REQUESTING FEDERAL <br />DISASTER REIMBURSEMENT FOR DEBRIS REMOVAL <br />FROM PRIVATE ROADWAYS FOR HURRICANE <br />FRANCES AND HURRICANE JEANNE. <br />WHEREAS, Indian .River County suffered catastrophic losses due to the direct <br />effects of initially, Hurricane Frances, and subsequently , Hurricane Jeanne, and <br />. WHEREAS, Hurricane Frances and Hurricane Jeanne were each officially <br />recognized and declared disasters by the local, state, and federal government agencies <br />having appropriate legal authority to do so; and <br />WHEREAS, the direct impact of two hurricanes on a single community within a <br />period of three weeks is historically unprecedented; and <br />WHEREAS, the magnitude of two combined disasters has generated massive <br />amounts of hurricane -generated debris throughout unincorporated Indian River County <br />on both public and private property; <br />WHEREAS, the combined effects of Hurricane Frances and Hurricane Jeanne <br />has caused the removal of hurricane -generated debris throughout unincorporated <br />Indian River County on both public and private property to be in the public interest as <br />necessary to eliminate immediate threats to life, public health, and safety of all of the <br />residents of the County; <br />WHEREAS, Section 206.224 of Title 44 of the Code of Federal Regulations <br />allows assistance to be provided for the removal of debris and wreckage from publicly <br />and privately owned lands and waters, when it is determined that the removal of such <br />debris is in the public interest; <br />WHEREAS, pursuant to Section 206.224 of Title 44 of the Code of Federal <br />Regulations, removal of debris and wreckage from publicly and privately owned lands <br />and waters is in the. public interest when it is necessary to eliminate immediate threats <br />to life, public health, and safety; eliminate immediate threats of significant damage to <br />improved public or private property; or ensure economic recovery of the affected <br />community to the benefit of the community -at -large; <br />WHEREAS, many of the residents of Indian River County live .in private <br />communities on private streets where Federal Emergency Management Agency <br />reimbursement would not normally be granted; and <br />F:\attorney\mef\HURRI CANE FRANCES\DEBRIS RESOLUTION Jeanne and Frances.doc 1 <br />
