It <br />i <br />MR. MACADAMS STATED HE FELT THERE MIGHT BE SOME IMPROPRIETY IN <br />PURCHASING A PARK WITH FEDERAL FUNDS WHERE A SEWER PLANT IS BEING OPERATED BY <br />PRIVATE PARTIES FOR THEIR GAIN. <br />ATTORNEY COLLINS POINTED OUT THERE ARE MANY PARKS IN FLORIDA <br />WITH PRIVATE CONCESSIONAIRES LOCATED ON THEM, AND IN ANY EVENT THE <br />SEWAGE PLANT WAS THERE BEFORE THE PURCHASE OF THE PROPERTY, <br />ATTORNEY COLLINS INFORMED THE BOARD THAT VAL BRENNAN HAS <br />FORWARDED HIM A SUGGESTED ORDINANCE IN REGARD TO -IMPLEMENTING THE COMP- <br />REHENSIVE LAND USE PLAN .AND HE NEEDS A DESCRETIONARYDECISION FROM THE BOARD <br />AS TO THE BASIS ON WHICH THIS PLAN IS GOING TO BE IMPLEMENTED. <br />CHAIRMAN SIEBERT NOTED THAT HE HAD THOUGHT IT WAS AGREED THIS <br />SHOULD BE DONE MORE OR LESS IN A GUIDE FORM DESIGNED TO SHOW SOME PROGRESSION <br />OVER A PERIOD OF TIME. <br />COMMISSIONER LOY ASKED IF THERE WERE ANY INDICATIONS THAT THE <br />IMPLEMENTING IS GOING TO BE EXTENDED ON THE STATE LEVEL. <br />IT WAS NOTED THAT THERE IS A BILL TO EXTEND, BUT IT IS DOUBTFUL <br />THAT THERE WILL BE ANY ACTION ON IT SOON AND WE MUST CONFORM WITH THE STATE <br />LAW IN 1979. <br />MR. BRENNAN POINTED OUT THAT THE BOARD HAS TO APPOINT A LOCAL <br />PLANNING AGENCY BY JULY IST OF THIS YEAR BY RESOLUTION. <br />COMMISSIONER LOY AGREED THAT WE SHOULD ADOPT AN ORDINANCE <br />AS A GUIDE, BUT FELT WE MUST GIVE MORE DIRECTION AS TO HOW WE ARE GOING TO <br />ACCOMPLISH THE ULTIMATE GOAL OF CHANGING THE ZONING TO FIT THE MASTER PLAN. <br />COMMISSIONER SCHMUCKER NOTED THAT THE ZONING DEPARTMENT IS <br />NOW GOING OVER THE ZONING SECTION BY SECTION AND TRYING TO MAKE IT FIT <br />THE MASTER PLAN. <br />MR. BRENNAN STATED HE FELT WE ARE BEING MISLED IN ASSUMING THE <br />ZONING ORDLNANCE HAS TO CONFORM TO THE MASTER PLAN AS HE DID NOT INTERPRET <br />THE LAW TO DEMAND THAT. <br />CHAIRMAN SIEBERT ASKED IF THEY,PLANNED TO INCLUDE IN THE IMPLE- <br />MENTING ORDINANCE THE ABILITY TO REZONE WITHOUT BEING IN CONFORMANCE WITH <br />THE MASTER PLAN AS HE PERSONALLY FELT IF YOU CAN REZONE ANY TIME IN CONFE t'T <br />WITH THE MASTER PLAN, WHY HAVE ONE. <br />APR 2 11976 <br />28 <br />A ; <br />UJ - <br />T <br />r <br />
