JENKINS OUT OF BUSINESS, WHICH HE FEELS IS A <br />REAL HARDSHIP, ESPECIALLY IN REGARD TO A PIECE OF PROPERTY THAT HAS BEEN <br />MINED SINCE THE '30"S. HE ASKED THAT THE.BOARD PERMIT MR. .JENKINS TO <br />CONTINUE IN HIS BUSINESS SUBJECT TO THE REQUIREMENTS SET OUT IN THE LETTER <br />FROM THE INDIAN RIVER FARMS DRAINAGE DISTRICT. <br />MR. .JENKINS TOOK THE FLOOR AND STATED THAT HE REALLY FEELS THE <br />BOARD OF COUNTY COMMISSIONERS IS DOING A GOOD JOB ON THE NEW PIT OPERA— <br />TIONS, AND HE DOES NOT DISAGREE WITH WHAT HAS BEEN DONE AT ALL AS IT IM— <br />PROVES THE PROPERTY AND ELIMINATES HAZARDS. HE CONTINUED THAT HE HAS HAD <br />A TOPO RUN ON HIS PROPERTY AND THERE IS PROBABLY ONLY ABOUT 300,000 YARDS <br />OF MATERIAL LEFT TO MINE. HE STATED THAT HE WOULD LIKE TO GO IN AND <br />FINISH IT AND MAKE THE PROPERTY WORTHWHILE TO BE USED FOR SOMETHING RATHER <br />-. <br />THAN DESTROY IT. <br />CHAIRMAN SIEBERT ASKED DEWEY WALKER, ZONING DIRECTOR, TO STATE <br />THE POSITION OF THE COUNTY. <br />o <br />MR. WALKER INFORMED THE BOARD THAT IN 1957 THE ZONING ORDINANCE <br />ALLOWED MINING IN AGRICULTURALLY ZONED DISTRICTS; HOWEVER, IT WAS STIPU— <br />LATED THAT A PIT COULD NOT COME CLOSER TO A ROAD RIGHT—OF—WAY THAN 150 <br />FEET. IN 1957 THIS PROPERTY WAS REZONED TO M-1, WHICH DOES NOT AL. <br />MINING. MR. JENKINS WAS WARNED IN NOVEMBER OF 1972 THAT HE MUST COMPLY <br />WITH THE NEW COUNTY REGULATIONS PERTAINING TO DIRT MINING. MR. WALKER <br />PRESENTED AERIAL PHOTOS OF THE PROPERTY SHOWING THAT IT HAS BEEN DUG OUT <br />1 <br />IN A MINING OPERATION SINCE 1973 AND IS DUG OUT RIGHT UP TO THE PROPERTY <br />LINE, WHICH IS A CLEAR CUT VIOLATION OF THE ZONING ORDINANCE. <br />n <br />MR. WALKER INFORMED THE BOARD THAT CEASE AND DESIST ORDERS <br />HAVE ALSO BEEN,ISSUED TO PAN AMERICAN ENGINEERS, MR, CARLSWARD AND H. L. <br />FLETCHER, AND THEY MUST ALL COMPLY WITH THE REGULATIONS BEFORE THEY CAN <br />BEGIN THEIR OPERATIONS AGAIN, MR. JENKINS` SITUATION, THEREFORE, IS NOT <br />AN ISOLATED CASE, AND HE HAS NOT BEEN SINGLED OUT. MR. WALKER FURTHER <br />NOTED THAT PAN AMERICAN ENGINEERS HAVE SAID THEY WOULD COMPLY BEFORE THEY <br />HAUL ANY MORE MATERIAL, AND MR. CARLSWARD HAS FILLED IN AND IS AT PRESENT <br />` <br />ASKING FOR A REZONING TO BUILD RESIDENCES.` <br />
