JUL 71 <br />M <br />L E A S E <br />THIS LEASE made and entered -into this 28th day of June, 1976, by <br />and between the TOWN OF INDIAN RIVER SHORES, a municipal corporation <br />existing under the laws of the State of Florida, hereinafter referred <br />to as "Lessor," and INDIAN RIVER COUNTY, FLORIDA, a political sub- <br />division of the State of Florida, hereinafter referred to as. "Lessee;" <br />W I T H E S S E T Hs <br />That the Lessor, in consideration of the rent hereinafter <br />expressed to be paid, does hereby lease unto the said Lessee that <br />certain property located in Indian Ri-rer County, Florida, more particu- <br />larly described as follows, to -wits <br />Tract 9, Section 21, Township 32 South, Range 39 East, <br />Indian River Farms Company Subdivision, as recorded in Plat <br />Book 2, Page 12, St. Lucie County, Florida Public Records. <br />TO HAVE AND TO HOLD THE SAME: <br />Unto the said Lessee for a term of eighteen (18) years beginning <br />on the 15th day of June, 1976, at and for the sum of One ($1.00) Dollar <br />per year rental to be paid in advance, the receipt of $18.00 upon the <br />execution of this lease being acknowledged, provided, however, that <br />in the event the City of Vero Beach sells the electric utility power <br />plant how owned by it, then upon such sale bein, consummated, the <br />.term of this lease shall be changed to a period of thirty (30) years <br />from the beginning date hereof. <br />This lease is executed between the parties upon the following <br />terms and conditions, to -wit: <br />1. The leased premises will be used by the Lessee for public <br />park purposes and will be maintained by the Lessee as such and for no <br />other purpose during the term of this lease, or any extension thereof, <br />and any and all taxes or assessments that may be made against said <br />property during said term will be borne by the Lessee. <br />2.. During the term of this lease, or any extension thereof, the <br />Lessee covenants and agrees with the Lessor that said leased premises <br />will be kept in proper condition and that any improvements'that may <br />be placed thereon by the Lessee during the term of said lease, or <br />any extension thereof, may be removed by the Lessee at the termina- <br />tion of this lease, provided that in the removal thereof, no damage <br />shall be done to the leased premises, and that upon the termination <br />of this lease, the leased premises will be returned to the Lessor <br />M <br />«�.r 2 4 <br />
