• L <br />MINING REVIEW COMMITTEE <br />REPORT ON BUD JENKINS' MINING OPERAT40N <br />On August 2nd, 1976, the Mining Review Committee met to review the <br />- <br />cease and desist order issued by.Indian River.County. <br />At the meeting, Mr. Vocelle, attorney for Mr. Jenkins, admitted his <br />client was in violation. He also stated that if his client had to backfill <br />(401 on the north end, it would cost $250,000. or more, and this would bank- <br />rupt Mr. Jenkins. Mr. Jenkins requested permission to "square" off the lake <br />and "dress it up" and then he would quit mining on the property. He.even <br />offered to sign an agreement to this effect. <br />i <br />It was pointed out that the land in question was zoned M-1, and that <br />I <br />it did not permit mining. It was further stated that the M-1 Zoning Ordi- <br />nance never did allow mining operations, and therefore the question of <br />"Grandfather clause" was a dead issue. After a good deal of discussion by <br />the committee members, it was decided that the committee would visit the site <br />at the invitation of Mr. Jenkins. The following morning, we physically in- <br />spected the condition as it now exists. It was determined that the north <br />haters edge of the pit -was approximately 125' from the center -line of the <br />• ve <br />North Relief Canal. The total canal right-of-way is 2501, so.- without <br />question - the digging was to the property line. We also found that the land <br />Was low and spotted with small pits. Following a discussion among committee <br />members, and a review of the aerial photos for the years 1943, 1951, 1957, <br />1970, 1973 and 1975, we could see that there was a continuous expansion of'' <br />the mining area operation (see attached aerials) contrary to Zoning Regulations <br />from 1957 (see Dewey's zoning history). <br />AUG 181976 <br />� � . � � � <br />
