or cease to be a resident of the district from which he qualified shall thereby become <br />disqualified to act as a Commissioner, and the office of that Can-ni.ssioner shall be <br />deemed vacant. The Commission shall divide the County into five (5) districts of <br />contiguous territory as nearly equal in population as practicable from time to time <br />end at least after each decennial census. <br />B. All C=Tdssioners shall be elected for staggered terns of four (4) years. <br />The Commissioners fran even numbered districts shall be elected as Group'A and the <br />Commissioners from odd numbered districts shall be elected as Group B. The terms of <br />office shall begin on the Tuesday two (2) weeks following the day of the general or <br />special election. <br />C. The Cmuissioners' salaries shall be established in. accordance with general <br />law, and the Commissioners at any time may reduce their salaries by ordinance to a <br />level commensurate with their reduced duties and responsibilities under the Charter. <br />The Comuissicmers shall not be reimbursed for expenses other than those specifically <br />approved by the .Cami ssion. Expenses shall be reimbursed only when incurred according <br />to the limitations ar:d.standards established by the Organizational Ordinance and shall <br />not exceed the limits set by general law. <br />D. The Constitutional office of*Cosmissi*cner of Indian River County shall be <br />abolished on January 1, 1977, and the Caumissioners thein serving shall assume office <br />as Commssioners provided by this Charter in Group A or Group B, respectively, vs the <br />ease may be, to serve the sane number of years as an officer of Indian River County <br />as shall remain in the respective term to which each was elected as a Constitutional <br />County Commissioner of Indian River County. The terms of Group A and Group B shall <br />end on the Tuesday two (2) weeks following the date of the general election held in <br />-the last year of the term for which the Camissioners in Group A and Group B Caere <br />elected as Constitutional Officers. <br />Section 2.02. VACANCIES IN THE OFFICE OF CCK,,MIONER. <br />Vacancies in offices of Commissioners shall be those defined by the Constitution.. <br />and I.azas of Florida and, in addition, shall occur when a Commissioner changes his <br />principal residence from or ceases to be a resident of the district from which he was <br />qualified. If a vacancy occurs . in the office of a Canmi.ssioner, the vacancy shall be <br />filled within sixty (60) days by an appointment made by a majority of the remaining <br />members of the Commission. Should the Commission . fail to fill a vacancy within this <br />period a special election shall be held within an additional sixty (60) days to fill <br />the vacangr; provided, however, if there shall be a general election to be held <br />within one hundred twenty (120) days of such a vacancy, then, there shall not be a <br />special. election. Should there be. three (3) or amore unfilled vacancies. they shall <br />be filled by the Governor as prescribed by the boas of Florida. Any vacancy filled <br />airy of the above methods shall be filled for a term to end on the Tuesday two (2), w� <br />follaaing the date of the general election. <br />Sectia n 2.03. DUMES OF THE CMMSIM. <br />A. The Commission shall have all jurisdiction and powers which are now or which <br />hereafter may be granted to it by the Constitution. and Laws of Florida and such powers <br />shall be exercised in a manner consistent with this Charter. Except as otherwise speci- <br />fied herein, all jurisdiction, power and authority shall be exercised by a vote of not <br />less than three (3) Commissioners at a regular, special or emergency meeting of the <br />Cc miission. The Comuussicn, in addition to the powers and duties. provided in this. <br />(barter, shall have the specific power and duty to. - <br />00 <br />o:(1.) appoint the Administrator by a vote of four (4) Commissioners and suspend <br />it remove the Administrator by a vote of three (3) Commissioners; <br />(2.) adopt, amend or repeal such ordinances or resolutions as it deems necessary <br />or advisable to exercise the powers and perform. the duties granted to the County; and <br />(3.) review the budgetary requirements and make. budgetary detexnmrinations and ap- <br />propriations for all County operations including, but not l.uni.ted to, those of all <br />elected County officers, those of the Administrator, those of all county departments <br />and offices and those of all authorities, boards, commissions, districts and other <br />agencies of the County, or portions thereof, hereinafter called "county agencies". <br />SEP 81976 <br />Le <br />
