M <br />Q <br />Section 1. 05. USE OF POWERS FOR TM PROTECTION OF CITIZENS' PROPERTY RIGHTS. <br />In order to protect the residents of the County against unlawful taxes, improper <br />use of public property or taxing power, and abuse of the environment, the County shall <br />have the power and duty to investigate and by ordinance or by civil or criminal legal <br />ac_alon, where appropriate, to prevent: <br />(1.) the imposition of any tax within the County in excess of the limitations <br />imposed by the Florida Constitution or the Largs of Florida; <br />(2.) the use of public property.or taxing power within the County for the benefit <br />of private individuals or business entities in violation of the restrictions imposed by <br />the Florida Constitution or the Laws of Florida; <br />(3.) the development or use of land or the c.cmni.ssion of other acts by private <br />individuals or business entities which will have a substantially adverse effect on <br />the fit. <br />Section 1.06. TRANSFER OF POWERS. . <br />The County shall have the power and authority by ordinance to assume and perform <br />such obligations and functions now or hereinafter assumed -or performed by any munici- <br />pality, <br />spy=ci al district or agency whenever such municipality, special district or <br />agency shall request the County to assume or perfornusuch obligations or functions. <br />Section 1.07. DIVISION OF POWERS. <br />This Charter hereby separates the legislative and adimnistrative functions of <br />County government: the establishment and adoption of law and policy shall be the <br />responsibility of the Legislative Branch and the execution of the law and policy <br />shall be the responsibility of the Administrative Breach. <br />Section 1.08. CONSTRUCTION. <br />The powers granted by this Charter shall be construed liberally in favor of the <br />County. The specified powers in this Charter shall not be construed as limiting; in <br />ay way the general or special powers of the County. It is the intent of this Article <br />to grant to the County full l power and authority to exercise all governmental and other <br />powers necessary for the effective operation and conduct.of the affairs of the County. <br />Section 1.09. SEVERABILITY. <br />If ani article, section, subsection, sentence, clause or provision .of this Charter <br />or the application thereof, shall be held invalid for any reason, the remainder of this <br />Charter and of any ordinance, regulation or resolution made thereunder shall remain in <br />full force and effect. <br />IEGMATIVE BRANCH: =m ca+aSSI0N <br />Section 2.01. O0MSITION, TERMS, quAm-ICATIONS AND CC TOSATION OF MDMM. <br />A. The legislative power of the County shall be vested -in the Indian River County <br />Clammission, hereinafter referred to as the "Commission". As of the effective date of <br />this Charter, the Commission shall be composed of five (5) members elected countywide <br />on a partisan basis. There shall be five (5) Commission Districts. The County Coen <br />missioners, hereinafter referred to as the "Comidssioners", shall be electors of the <br />County and shall reside in the district which they are to represent on the date on <br />which they qualify.
