INDIAN RIVER COCM HOME RULE CHARTER <br />September 1, 1976 <br />PREAMBLE <br />The citizens of Indian River County, joined together with the knowledge that <br />the purpose of county goverment is to benefit its residents, do hereby avail them - <br />`selves of the opportunity afforded by the Florida Constitution and Laws of the State <br />af Korida to adopt a County Home Rule Charter in the belief that such action will <br />serve to create a more responsive and efficient form of local goven nent. <br />-- ARTICLE I <br />POWERS OF GOVERM4ENT <br />Section 1.01. POLITICAL SUBDIVISION. <br />Indian Fiver County shall be a political subdivision of the State of Florida, <br />shall be a body corporate and politic and shall have all rights and powers of local <br />self-govenmmt crni.cn are now, or hereafter may be, provided by the Constitution <br />and Laws of Florida and this Home Rule Charter hereinafter referred to as the "Charter". <br />Section 1.02 NAVE AND BOUNDARIES. <br />The corporate name shall be 'Indian River County", hereinafter referred to as <br />the "County", and it shall be so designated in all actions and proceedings tauching <br />its rights, powers, properties and duties. Its seat and boundaries shall be those <br />presently designated by law. <br />Section 1.03. CEERAL POSERS OF THE COUNTY. <br />A. The County shall have all powers acid duties prescribed in the Constitution, <br />the Laws of Florida and this Charter and shall have all powers of .local self- <br />govern-ment not inconsistent with the provisions of this Charter. <br />B. 'All pokers of the County shall be carried into execution as provided by this <br />Charter or, if the Charter makes no provision, as provided by ordinance or resolution <br />of the County Commission or by the Constitution and Laws -of Florida.. <br />Section 1.04. SPECIAL POWERS OF TEE (MINTY. <br />A. .The County, operating under this Charter, shall have all special pagers and <br />duties which are not inconsistent with this Charter heretofore granted by-law to the <br />Board of County Commissioners and shall have such additional county and municipal <br />powers as may be required to fu1fi11 the intent of this Charter. <br />B. The County shall have all necessary powers to accomplish all local govern- <br />ment purposes by and within special districts. <br />C. Property situated within municipalities shall not be subject to taxation for <br />services rendered by the County exclusively for the benefit of residents or <br />property not within municipal boundaries, nor shall property situated outside of <br />aamicipal boundaries be subject to taxation for services provided by the County ex- <br />clusively for the benefit of residents or property within municipal boundaries. <br />SEP 81976 <br />��r 26 <br />
