Section 7.02. am= REVIm4---Bu= APPEAiS BOARD, <br />A. There shall be a Charter Review --Budget Appeals Board hereinafter referred <br />to as the "Board". The Board shall be composed of five (5) manbers elected county- <br />wi& nn a partisan basis. Each County Commission District shall constitute a Charter <br />Review --Budget Appeal's Board.District and each such district shall have the same <br />district ni er'zz that of the corresponding Commission District. The Board members <br />shall be electors of the Cotet, and shall reside in, the district which they are to <br />represent on the date en which they qualify, Any Board member who shall change his <br />principal residence .£roan or cease to be a resident of the district frau which he <br />qualified shall thereby became disqualified to act as a Board member and the office <br />of that Board member shall be deemed vacant, <br />B. The first members of the Board shall be appointed by the ComAssiom within <br />three (3) nnnths fran the effective date of this Charter. Each member shall be ap- <br />pointed for a term to expire at the time of the expiration of the term of office of <br />the Commissioner representing the same numbered district. Thereafter, the members <br />of the Board shall be elected in the same manner, at the same time and for the same <br />teen of office as the Carnissioner representing the corresponding Ccnrnissio n District. <br />A vacancy in office of any meeiber of the Board shall be filled by.appointTen.t by the <br />Board for a'term to end at the next general election. <br />C. McAbers of the Board shall serve without compensation but shall be allaomed <br />necessary expenses when approved by the Cc mri..sSion. <br />D. The Board shall be funded by the Coatadssiori. <br />Section 7.03. POWERS OF ME allUMR. REVIZI--BUDGET APPEAIS BOAM. <br />A. The Board shall be empowered to conduct a continuing study of any or all <br />phases of County goverment. <br />B. After -cue (1) year from the effective date of this Charter the Board may, <br />by vote of four (4) members, adopt a proposal to amend or repeal this Charter. <br />C. if the proposal is presented to the Commission more than sixty (60) days be- <br />fore the next general or special election, the Cormissiom shall. submit the proposal <br />to the County electors at that election. If the proposal is submitted within sixty <br />(60) days of such election, then the proposal shall be submitted by the Commission to. <br />the Camty electors at the following general or special election: ; , provided, however, <br />that if there is none scheduled within the neat one hundred twenty (120) days, the <br />Coun[dssion shall call a special election so that the electors may vote on the proposal.. <br />D. The Commission shall notify each elected County officer of its final action <br />on his section of the budget. Within five (5) days after that notice, any elected County <br />officer may file his written appeal to the Board requesting a review of the budget <br />items specified in the appeal and the elected County officer shall file a copy of his <br />appeal with the Ccamissien. <br />E. The Board shall within fourteen (14) days of receipt of such appeal hold a <br />hearing on the appeal. <br />F. The Board shall hear arguments in a manner prescribed by the Board; of the <br />C omission, the elected County officer and all other interested parties. <br />G. Within a reasonable period of time, the Board by majority vote shall determine. <br />the validity of all items on appeal. <br />H. the Board shall send its decision to the Condssion, <br />I. In the event of a change, the Camdssion shall readjust the elected CoMty <br />officer's budget in accordance with the decision of the Board. <br />J. The Board shall create and elect appropriate officers as it deems necessary <br />and proper for the orderly conduct of its specific duties. <br />
