SEP <br />Section 7.04. OOIDUCT OF COUNTY ORDINANCES WrM MUNICIPAL ORDINANCES. <br />14otAthstanding other provisions of this Charter, any county ordinance in <br />conflict with a municipal ordinance shall not be effective within the municipality <br />to the extent of auh conflict regardless of whether such municipal ordinance was <br />adopted or enacted before or after the county ordinance. A municipal ordinance shall <br />also prevail over a county ordinance in the area of comprehensive land use planning. <br />In the event a county ordinance and a municipal ordinance shall cover the same subject <br />matter without conflict, both the municipal ordinance and the county ordinance shall <br />be effective, each being deemed supplemental, one to the other. <br />Section 7.05. SPECIAL TANG DISTRICTS OR UNITS. <br />A. The Commission shall have full power to create, alter, or abolish special <br />taxing districts or units to the full extent granted by the Constitution and the <br />Laws of Florida; provided, however, that such actions must be confirmed by an <br />election in which only those electors in such a district or unit shall be eligible <br />to vote. A majority of those voting in said election must confirm the actions of <br />the Commission - <br />B. - <br />ommissian. <br />B,. All special taxing districts or units created after January 1, 1977, within <br />the County shall be subject to such uniform budget and audit procedures as may be es- <br />tablished by the Comnission, and they may be required by the Commission to utilize any <br />county services. Such services may be providzd at a rate o€ -compensation not above <br />actual costs as determined by the Commission. <br />C. The Commission may by ordinance create districts for the purpose of levying <br />ad valorem taxes or special assessments to pay for the furnishing of municipal services, <br />and the taxes imposed shall be within the limits set for municipal purposes. Each such <br />district created must be confirmed by an election in which only those electors in that <br />district shall be eligible to vote. <br />Section 7.06. EFFECT OF DUCAL LAWS. <br />All existing laws, ordinances, regulations, and resolutions of all units of the <br />former government that are not inconsistent with or in direct conflict with the <br />provisions of this Charter shall remain operative. <br />Section 7.07. LEGAL ACTION INVCLVING ME COUNTY. <br />In any legal action by or against the County, or any of its departments, agencies, <br />officers or employees in their capacities as such, the County as a Corporate Body shall <br />be the party named and shall appear and participate in the cause on behalf of the <br />department, agency, officer or employee. Wherever the County Sheriff, County Property <br />Appraiser, County Tax Collector, County Supervisor of Elections, County Clerk of the <br />Circuit Court or Board of County Commissioners may or shall be a party to any legal <br />action, the County shall be substituted for such defendant. <br />Section 7.08. ECISTING CONTRACTS. <br />No provision of this Charter shall be construed to interfere with any valid con- <br />tract subsisting on the effective date of this Charter. <br />Section 7.09. UMURM BUDGET PROCEUME. <br />All County departments, offices and agencies, and all elected County officers, <br />shall operate under a unified and uniform budget system. No officer or employee of <br />the County shall be cca pensated by fees, and all fees collected by any department, <br />office, agency or elected County officer shall be deposited in the County treasury. <br />8 076 <br />-14- <br />'���-` 26 <br />
