WHEREAS, as a result of said discussions, the County agreed in <br />principle to pay to the City for said right-of-way, the cost of relocat- <br />ing the City's said facilities, then estimated at $390,000.00, which <br />figure has been modified upwards because of requirements imposed by the <br />United States Department of Transportation, which agency is contributing <br />to said project; and, <br />WHEREAS, the County, by its Commissioners, in meeting, assembled <br />on October 5, 1976,. agreed to pay to the City of Vero Beach, such sum of <br />$403,600.00 for said right-of-way. <br />NOW THEREFORE, be it hereby resolved by the City of Vero Beach <br />by its Council, assembled, and it hereby resolved by authority of the same: <br />SECTION I <br />In accordance with paragraph 11, Final Judgment, Case No. 75-106, <br />Barbara Jenkins, Plaintiff, vs. City of Vero Beach, Defendant, Circuit <br />Court of the 2nd Judicial Circuit, Leon County, Florida, City Council <br />hereby finds and determines that Disposition of the property described <br />or identified in Section II below constitute a Disposition of the property. <br />interests which are."no longer necessary, useful or profitable in the <br />operation" of the City electric system. <br />SECTION II <br />The City of Vero Beach will accept fiom the County of Indian <br />River as full payment for the right-of-way to the westerly approach to <br />the 17th Street bridge strip of land 100 feet wide running from the <br />intersection of Indian River Boulevard and 17th Street to the westerly <br />bank of the Indian River, the sum of $403,600.00. <br />SECTION III <br />Upon the presentation and tender of such payment, the proper <br />City officers be and they are hereby directed to execute and deliver to <br />the County of Indian River or the State of Florida, if the County of <br />Indian River so directs, the necessaryinstrument conveying such right - <br />of -way. <br />ight-of-way. <br />2 - <br />OCT 1976 27 29 <br />I <br />
